Why Action is Necessary
A. In accordance with the Broward County Procurement Code, Section 21.34, a sole source/brand above the award authority of the Director of Purchasing must be approved and awarded by the Board.

B. In accordance with the Broward County Procurement Code, Section 21.31.a.4, the Board is required to approve all purchases exceeding $250,000 per annum or $400,000 in a multi-year period.

B. Provides for Prysmian Cables for use at the Port Everglades Department.

Summary Explanation/Background
THE PURCHASING DIVISION AND THE PORT EVERGLADES DEPARTMENT RECOMMEND APPROVAL OF THE ABOVE MOTIONS.

The Office of Economic and Small Business Development did not assign participation goals to this contract based on the sole brand request (Exhibit 2).

The purpose of this contract is to provide Prysmian Cables. Prysmian Protolon cables supply main power from the dock power trench to Port Everglades SP-4 and SP-5 cranes. The cables provide the conductors from the main power and fiber optics for the crane communications and remote diagnostics. Prysmian Spreaderflex cables provide power, control and communications to the crane’s head-block and consequentially to Port Everglades Bromma spreaders.

On June 23, 2017, the Purchasing Division issued Request for Information (RFI) No. X2114872F1 to ascertain whether there were equivalent products specified as a sole brand by the Port Everglades Department. The RFI yielded two responses which both offered Prysmian Cables, not any other brands. A competitive solicitation was issued to the two firms, and American Safety Utility Corporation (the second firm) indicated that it was not able to submit a bid at this time; however, it may be interested in the future.

On October 4, 2017, the Assistant Director of Purchasing approved the Sole Source/Sole Brand Request (Exhibit 5).

The purchasing agent has researched the prices submitted by the single bidder, Cavotec USA, Inc., and has determined that the prices submitted are fair and reasonable based upon a comparison to the manufacturer’s quotes (Exhibit 4).

The Port Everglades Department has reviewed the bid submitted by Cavotec USA, Inc. and concurs with the recommendation for award (Exhibit 3).

One vendor performance evaluation has been completed for Cavotec USA, Inc.; the firm has an overall rating of 4.94 out of a possible rating of 5.0. A copy of the vendor performance evaluation is available upon request.

There was no protest or appeal filed regarding this procurement.

The bid posted on November 30, 2017 and opened on December 11, 2017; one bid was received with one declination (Exhibit 1).
