MOTION TO DIRECT Office of the County Attorney to draft an Ordinance amending Chapters 20-9 and 8½-16(y) of the Broward County Code of Ordinances to conform with Florida Statute requirements on posting of gasoline prices at gasoline service stations.

Board action is required to direct the Office of the County Attorney to draft amendments to the Broward County Code of Ordinances.

Summary Explanation/Background
THE ENVIRONMENTAL PROTECTION AND GROWTH MANAGEMENT DEPARTMENT AND THE ENVIRONMENTAL AND CONSUMER PROTECTION DIVISION (ECPD) RECOMMEND APPROVAL OF THE ABOVE MOTION.

Approval of this item will permit the County Attorney's Office to draft a proposed ordinance to make Broward County's rules on gasoline price signage consistent with state requirements. 

Per Florida Statute 570.07(16), Broward County is limited to enforcing state requirements for gasoline service station price signage. Therefore, Chapter 20 of the Broward County Code of Ordinances (Code) must be updated to conform with the state requirements. Proposed changes will include allowing posting of discount prices when the condition of the discount is also posted and changing Broward County requirements on sign letter height. These changes will also be reflected in civil penalties listed in Chapter 8½-16 of the Code.
