MOTION TO AUTHORIZE Director of Purchasing to approve and execute resultant agreements which piggyback off of the State of Florida Contract No. DMS-08/09-029, Solar Energy Services, in support of Broward County's overall commitment to a healthy, sustainable environment and its development of programs and policies to support climate protection, energy conservation and Greenhouse Gas (GHG) emissions reductions.

Why Action is Necessary
In accordance with the Broward County Procurement Code, Section 21.31.a.4, the Board is required to approve all purchases exceeding $250,000 per annum or $400,000 in a multi-year period; and in accordance with the Broward County Procurement Code, Section 21.135.a.2, the Purchasing Division is expressly authorized to directly purchase from contracts generated by the State of Florida; and in accordance with the Broward County Procurement Code, Section 21.14.c.6, the Director of Purchasing shall execute all contracts and amendments delegated by the Board for the Director's execution.

Summary Explanation/Background
THE PURCHASING DIVISION AND THE ENVIRONMENTAL PROTECTION AND GROWTH MANAGEMENT DEPARTMENT/ENVIRONMENTAL PLANNING AND COMMUNITY RESILIENCE DIVISION RECOMMEND APPROVAL OF THE ABOVE MOTION.

This item supports the Board's value of “Encouraging investments in renewable energy, sustainable practices and environmental protection" and its goal, "Seek funding for, implement policies and pursue projects promoting, the use of alternative energies and sustainable practices".

The Office of Economic and Small Business Development did not assign County Business Enterprise goals for this procurement because of the Broward County Environmental Planning and Community Resilience Division's (EPCRD) intent to procure services through a pre-existing contract (Exhibit 2).

EPCRD requests to piggyback off of the State of Florida Contract No. DMS-08/09-029, Solar Energy Services. The Contract was issued through a competitive bid process, Invitation to Negotiate (ITN) No. DMS-08/09-029, Solar Power Pilot Project, which sought proposals for qualified vendors to design, install, operate and maintain a Solar Photovoltaic Electric Generating System (System) at their own cost at state-owned facilities. The Contract was awarded to Advanced Roofing, Inc. with an initial term, which began on December 14, 2009 and expired on December 15, 2015. Through Amendment No. 1, the Contract was renewed for an additional three years, commencing on January 1, 2016 and ending on December 31, 2018.  The term for the System(s) shall end no later than 20 years after commencement date (Exhibit 1).

The Contract will offer the County the opportunity to obtain installation of the Systems with no upfront capital investment while expanding the County's support for renewable energy projects and generating the potential for longer-term operational cost savings. The County will incur costs for energy services rendered by Advanced Roofing, Inc. in accordance with a Solar Energy Services Contract negotiated between Advanced Roofing, Inc. and the County, which will include a services and fee schedule.  The fee schedule will provide for quarterly payment for energy services delivered.  Projects will be proposed and presented for approval on an individual basis.  Fourteen performance evaluations were completed for Advanced Roofing, Inc.; the firm has an overall rating of 4.29 out of a possible 5.0. Copies of the vendor performance evaluations are available upon request.

Utilization of the Contract will allow the County to expand solar investments at county facilities without incurring the initial capital costs.  The County's financial participation will remain consistent with the cost of traditional energy sources, while reducing Greenhouse Gas (GHG) emissions, furthering the county's 20% renewable energy goal, and visibility promoting renewable energy systems  in support of Broward County's overall commitment to a healthy, sustainable environment and its development of programs and policies to support climate protection, energy conservation and GHG reductions.

The total value of the Contract being requested by EPCRD cannot be determined at this time, as the full extent of anticipated usage by potential County agencies is yet to be ascertained. However, consultations held with EPCRD by the Purchasing Division staff revealed the potential for a cumulative value of $1 million per project over the duration of 20-year contract, which would be offset by operational cost savings.
