MOTION TO ADOPT Resolution No. 2018-067 directing the County Administrator to publish a Notice of Public Hearing to be held on Tuesday, April 24, 2018, at 10:00 a.m. in Room 422 of the Governmental Center, 115 South Andrews Avenue, Fort Lauderdale, Florida to vacate a portion of a sanitary sewer easement lying within parcel “A” of Metropica Plat as recorded in Plat Book 179, Page 70 thru 76, both of the Public Records of Broward County, located at 1800 NW 136 Avenue in Sunrise at no cost to the County; Petitioner: Metropica Series C Venture, LLC; Agent: Ele Zachariades, Dunay, Miskel & Backman, LLP; Application for Vacation and Abandonment: 2018-V-06. (Commission District 1)

Why Action is Necessary
Board of County Commissioners' approval is required to vacate a sanitary sewer easement pursuant to Broward County Administrative Code, Chapter 25.

Summary Explanation/Background
THE PUBLIC WORKS DEPARTMENT/FACILITIES MANAGEMENT DIVISION/REAL PROPERTY SECTION RECOMMENDS APPROVAL OF THE ABOVE MOTION.

The 15-foot-wide sanitary sewer easement lies within parcel “A” of Metropica Plat as recorded in Official Records Book 24292, Page 210, of the Public Records of Broward County and is located at 1800 NW 136 Avenue in Sunrise in Section 26, Township 49S, Range 40E. The Folio Number affected by this proposed vacation is 4940-26-09-0010.

Vacating this sanitary sewer easement will provide clear and unencumbered title to the property owner, Metropica Series C Venture, LLC.

The City of Sunrise approved this vacation by adopting Resolution No. 17-96 on July 11, 2017. The Petitioner published a Notice of Intent to vacate on September 29, 2017 and October 06, 2017.

The vacation application and fee were received and the fee was deposited by the County's Real Property Section on November 20, 2017.

Review of this application by the County Attorney's Office, applicable Broward County agencies and utility companies was completed on February 09, 2018. No reviewing agency has indicated that the 15-foot-wide sanitary sewer easement is currently used, nor is there a plan for future use. No objections to this vacation were raised by any of the reviewing agencies.

This vacation application has been reviewed and approved as to form by the Office of the County Attorney.
