MOTION TO APPROVE Agreement between Broward County and Genfare, a Division of SPX Corporation, for Transit Mobile Ticketing and Fare Card Interoperability System, Request for Proposals (RFP) No. V1380512P1, in the total not-to-exceed amount of $8,980,892 for the initial three-year term, including $717,908 for optional services and $1,083,900 for spare parts for the duration of the contract, and authorize the Director of Purchasing to renew the agreement for seven optional one-year periods in the annual amount of $137,800, for a ten-year potential not-to-exceed amount of $9,945,492, and authorize the Mayor and Clerk to execute same. The initial term of this Agreement begins on the date of execution and terminates three years from the date of Mobile Ticketing Final Acceptance.

Why Action is Necessary
In accordance with the Broward County Procurement Code, Section 21.31.a.4, the Board is required to approve all awards exceeding $250,000 per year or $400,000 in a multi-year period.
What Action Accomplishes

Provides an agreement for a qualified firm to provide a transit mobile ticketing and fare card interoperability system for Broward County Transit (BCT) that will replace BCT’s current fare collection system with new fareboxes that can accept conventional forms of fare payments (cash and passes) as well as mobile tickets and the existing Miami-Dade and South Florida Regional Transit Authority (Tri-Rail) EASY Card.

Summary Explanation/Background
THE PURCHASING DIVISION AND THE TRANSPORTATION DEPARTMENT/TRANSIT DIVISION RECOMMEND APPROVAL OF THE ABOVE MOTION.

The item supports the Board's values "Cooperatively delivering an efficient and accessible regional intermodal transportation network" and "Consistently delivering responsive, efficient, quality services to the public and internal customers".

The Office of Economic and Small Business Development determined that this project is 100% funded by the Federal Transit Administration and, because federal dollars are applicable, the project is subject to the requirements of Title 49 CFR Part 266. The County has established an overall Disadvantaged Business Enterprise goal of 26.7% for federally funded transportation projects.

This Agreement will replace BCT’s current fare collection system with new fareboxes that can accept conventional forms of fare payments as well as mobile tickets and the existing Miami-Dade and South Florida Regional Transit Authority (Tri-Rail) EASY Card. The mobile ticketing option provides BCT customers the convenience of purchasing bus fares anywhere, any time with their mobile devices. The new fare collection system will improve the travel experience for riders that use the BCT system as well as those transferring to and from all four transit systems in the Southeast Florida Region: BCT, Miami-Dade Transit (MDT), Palm Tran, and Tri-Rail. Additional benefits of the new fare collection system include quicker passenger boarding process, resulting in improved performance and schedule adherence, reduced physical cash management by BCT resources, and improved reporting and analytics for revenue management. The Agreement may be renewed for some or all services provided. The Agreement allows the County to purchase up to 399 fareboxes for its current fleet and accommodates the predicted growth for 2018. It also allows for the purchase of farebox spare parts for up to ten years.

On January 5, 2016 (Item No. 27), the Board approved the Request for Proposals (RFP) No. V1380512P1, Transit Mobile Ticketing and Fare Card Interoperability System. Three firms submitted proposals in response to the RFP.

On March 30, 2016, an Initial Evaluation Meeting was held and all three firms were determined to be both responsive and responsible to the requirements of the RFP.

On April 15, 2016, a Final Evaluation Meeting was held and after presentations, evaluations and scoring, the Evaluation Committee selected Genfare, a Division of SPX Corporation, as the first-ranked firm.

The Evaluation Committee's proposed recommendation of ranking was posted on the Purchasing Division website from April 21, 2016 through April 25, 2016, which provided an opportunity for any proposer or interested party to present any new or additional information regarding the responsibility of the proposers. There was no additional information submitted within this timeframe.

The Evaluation Committee's final recommendation of ranking was posted on the Purchasing Division website from April 26, 2016 through May 2, 2016, which provided an opportunity for any aggrieved proposer to file a formal protest. There was no protest filed within this timeframe.

On June 14, 2016 (Item No. 60), the Board approved the Evaluation Committee's final ranking of the qualified firms and authorized staff to proceed with negotiations.

Five Sunshine meetings were held to negotiate this Agreement: July 21 and August 4, 2016, and June 23, June 30 and August 24, 2017 (reconvened on October 13, 2017 and December 21, 2017). These meetings were attended by representatives of Genfare, a Division of SPX Corporation, staff from the Transit Division, Enterprise and Technology Services, the County Attorney's Office and the Purchasing Division.

The development of the scope for this Agreement, along with its negotiations, took longer than expected due to several factors: 1) This was a joint procurement by Broward County and Palm Beach County. On September 28, 2016, PalmTran provided formal notice terminating the joint procurement; 2) Miami-Dade Board of County Commissioners approved the award of a contract to migrate its fare management system to a vendor supported Cloud environment with mobile ticketing. BCT, Genfare, and Miami-Dade Transit staff had to meet and agree on a general approach to proceed with interoperability solutions considering the changes in Miami-Dade Transit system; and 3) FTA review was required to evaluate trade-in options for BCT’s existing fareboxes that have not reached useful life for disposal when replaced by the new fareboxes.
 
The amounts referenced in this agenda were rounded off to the nearest whole dollar.

Vendor payments will be based on the actual maximum amount payable under this Agreement.

Each requirement processed against this Agreement will be funded by the appropriate funding source at the time of release. This project is funded with Federal Transit Administration grant funds budgeted within the Transit Division’s Capital Grant Fund.
