Requested Action
MOTION TO AWARD open-end contract to low bidder, Trio Development Corporation, for Sewer Lift Station, Rehabilitation and Repair, Bid No. Y2114640B1, for Water and Wastewater Services, in the annual estimated amount of $3,556,128, which includes allowances in the amount of $85,000 and authorize the Director of Purchasing to renew the contract for two one-year periods, for a three-year potential estimated amount of $10,668,384. The initial contract period begins on the date of award and terminates one year from that date, contingent upon receipt of the payment performance guaranty.

VOTE:  9-0.  Commissioners Geller and Sharief voted in the affirmative telephonically.
Why Action is Necessary
In accordance with the Broward County Procurement Code, Section 21.31.a.4, the Board is required to approve all purchases exceeding $250,000 per annum or $400,000 in a multi-year period.

Summary Explanation/Background
THE PURCHASING DIVISION AND THE PUBLIC WORKS DEPARTMENT/WATER AND WASTEWATER SERVICES RECOMMEND APPROVAL OF THE ABOVE MOTION.

The Office of Economic and Small Business Development (OESBD) established a County Business Enterprises (CBE) goal of 25% for this contract. Trio Development Corporation committed to 25% CBE participation, which has been reviewed and approved by the OESBD (Exhibit 2).

The purpose of this open-end contract is for the repair and rehabilitation of sewer lift stations, which includes: by-pass pumping, wet well repair and restoration, replacement of top slabs, hatches, pumps, pipes, valves, control panels, electrical services, connection panels, underground vaults, excavating and backfilling, disposal of surplus material, and site restoration.

This procurement carries a 25% performance and payment guaranty. The Purchasing Division confirmed with the surety company that Trio Development Corporation has the capacity to obtain the required guaranty.

The allowances incorporated in this contract, in the total amount of $85,000, include: $10,000 for non-Broward County permit fees, $50,000 for parts and materials and $25,000 for Florida Power & Light fees. Expenditures under these allowance items must be approved by the contract administrator and will be reimbursed at the contractor’s actual cost without mark-up.

In accordance with the Broward County Workforce Investment Program, Broward County Administrative Code, Section 19.211, these services are subject to the Workforce Investment Program. Trio Development Corporation has agreed to be bound to the contractual obligations of the Workforce Investment Program.

Water and Wastewater Services reviewed the bid submitted by Trio Development Corporation and concurs with the recommendation for award (Exhibit 3).Twenty-three vendor performance evaluations were completed for Trio Development Corporation; the firm has a rating of 4.42 out of a possible 5.0. Copies of the vendor performance evaluations are available upon request.

There was no protest or appeal filed regarding this procurement.

Incumbent: Trio Development Corporation, Contract Number Y1180908B1, Lift Station Rehabilitation and Repair; Contract Term: February 25, 2014 to February 24, 2017, expenditures to-date: $4,617,511.

On February 9, 2017, the Director of Purchasing approved the 90-day extension for Contract Number Y1180908B1 with Trio Development Corporation. The contract expired on May 25, 2017.

The bid posted on September 27, 2017 and opened on October 20, 2017; four bids were received with no declinations (Exhibit 1).
