Board of County Commissioners’ approval is required for amendments greater than $400,000 in accordance with the Broward County Procurement Code, Section 21.47.

Summary Explanation/Background
THE PUBLIC WORKS DEPARTMENT/FACILITIES MANAGEMENT DIVISION RECOMMENDS APPROVAL OF THE ABOVE MOTION.

The Public Works Department and the Office of Economic and Small Business Development (OESBD), established a 21% County Business Enterprise (CBE) participation goal for the agreement. SP Plus Corporation has committed to an overall CBE goal of 24.56%. To date SP Plus Corporation has been paid $2,227,002, of which, minimally $446,594 or 20.05% was paid to their CBE subcontractors. OESBD's compliance review and comments are provided in Exhibit 2.

On February 11, 2014 (Item No. 14), the Board of County Commissioners approved the Agreement between Broward County and SP Plus Corporation for Parking Management Services for various Broward County agencies, Request for Proposal (RFP) No. R1138035P1, for the Facilities Management Division. The agreement allows for reimbursement of ordinary direct operating costs and expenses incurred by the parking management firm in the operation of Broward County public and employee parking facilities. However, the cost for some reimbursable expenses, such as increased staffing for holidays and special events, operating expenses, County requested changes in garage operations, supplies, security and minor maintenance was inadvertently omitted from the agreement’s operating expense threshold.

On December 8, 2015 (Item No. 60), the Board of County Commissioners approved the First Amendment to the Agreement between Broward County and SP Plus Corporation for an increase in the contract threshold for years one, two and three.

Based on current usage, the total contract amount is not enough to cover year four and optional year five. This Second Amendment will allow for an increase in the contract threshold for this purpose.

This Amendment has been reviewed and approved as to form by the Office of the County Attorney and Risk Management Division. The amounts referenced in this agenda item have been rounded to the nearest whole dollar.
