MOTION TO APPROVE threshold increase of current open-end contract No. E1265902B1, Sludge Hauling Services for the Water and Wastewater Operations Division, in the amount of $1,010,886 for the remainder of the current contract term and $1,185,140 for the fourth and fifth renewal periods; for a total increase in the contract threshold not-to-exceed amount of $13,287,050 to $15,483,076. (Commission District 4)

Why Action is Necessary
In accordance with the Broward County Procurement Code, Section 21.31.a.4., the Board is required to approve all purchases exceeding $250,000 per annum or $400,000 in a multi-year period.
What Action Accomplishes
Provides a threshold increase in the sludge hauling services contract to provide for the continuation of these critical services for the remainder of the contract and the two remaining renewal periods.

Summary Explanation/Background
THE PURCHASING DIVISION AND THE PUBLIC WORKS DEPARTMENT/WATER AND WASTEWATER SERVICES DIVISION RECOMMEND APPROVAL OF THE ABOVE MOTION.

On December 9, 2014 (Item No. 48), the Board of County Commissioners approved the award of an open-ended contract to H & H Liquid Sludge Disposal, Inc. for Sludge Hauling Services in the not-to-exceed amount of $13,287,050. The contract was approved for an initial two-year period with three one-year renewal options.

The estimated annual contract amount was based on the County’s ability to dispose of sludge and grit at several local sites as well as at land application sites through the life of this contract. A recent agreement between Waste Management, Inc. of Florida, and the City of Coconut Creek now limit the volume of sludge and grit that can be disposed of at the local sites. This limitation was included in the recent restated leachate/sludge agreement between Waste Management, Inc. of Florida and Broward County which was approved by the Board of County Commissioners on December 13, 2016 (Item No. 39). Currently, the County is now redirecting some of the biosolids to other contracted locations such as the Okeechobee landfill and land application sites.

Based on the cost differential of the hauling of these biosolids outside of Broward County, staff is requesting a contract threshold increase in the amount of $2,196,026. This action will increase the total not-to-exceed contract amount from the current total of $13,287,050 to $15,483,076 and will be sufficient to provide these services for the remainder of the contract including years four and five of the renewal period.
