MOTION TO CONSIDER APPROVAL for an 18-month Extension of Impact Fee Credit for Block 58 development, consistent with the provisions of the Broward County Land Development Code addressing circumstances involving litigation beyond the control of the applicant.  (Commission District 6)

Section 5-180 (e) of the Broward County Land Development Code allows the Board to grant an extension of time for impact fee credits based on circumstances which are beyond the applicant's control.

Summary Explanation/Background
THE ENVIRONMENTAL PROTECTION AND GROWTH MANAGEMENT DEPARTMENT AND THE PLANNING AND DEVELOPMENT MANAGEMENT DIVISION RECOMMEND APPROVAL of this request.

Block 58 is located on the southeast corner of South Young Circle in the City of Hollywood (Exhibit 1). MG3 Hollywood, LLC (“Applicant”) is requesting an extension of time to claim credit for transportation concurrency impact fees (Exhibit 2). Development of the site has been delayed due to litigation involving a neighboring private property owner, Red Apple Hollywood, LLC. The Applicant is requesting an 18-month extension from the later date of either the issuance of demolition permit or the completion of all Block 58 litigation.

Section 5-180(e) of the Broward County Land Development Code provides that the Board may grant an extension of time commensurate with the delay caused by the litigation. Staff finds that unique and extraordinary circumstances were beyond the control of the applicant, and therefore recommends approval of the requested extension.
