THE PUBLIC WORKS DEPARTMENT/FACILITIES MANAGEMENT DIVISION/REAL PROPERTY SECTION RECOMMENDS APPROVAL OF THE ABOVE MOTION.
The 30-foot-wide right-of-way lies along the southern portion of Tract “A” of the F.F. Minione Plat as recorded in Plat Book 103, Page 11 of the Public Records of Broward County and is located at 1600 W Sample Road in Pompano Beach in Section 22, Township 48S, Range 42E. The Folio Number affected by this proposed vacation is 4842-22-18-0010.
Vacating this right-of-way will provide clear and unencumbered title to the property owner, Public Storage. The City of Pompano Beach approved this vacation by adopting Ordinance No. 89-18 on November 29, 1988. The Petitioner published a Notice of Intent to vacate on April 19, 2017 and April 26, 2017.
The vacation application and fee were received and the fee was deposited by the County's Real Property Section on June 01, 2017.
Review of this application by the County Attorney's Office, applicable Broward County agencies and utility companies was completed on October 18, 2017. Water Management Division of Broward County Water and Wastewater Services approved the vacation of the right-of-way on the condition that Public Storage grant to Broward County a 20-foot-wide utility easement over a portion of the property being vacated which is presented to the Board of County Commissioners for approval and acceptance as Motion B. No other reviewing agency has indicated that the right-of-way is currently used, nor is there a plan for future use.
The Board of County Commissioners approved the Resolution Authorizing Public Hearing on November 14, 2017 (Item No. 5).
The vacation application and utility easement have been reviewed and approved as to form by the Office of the County Attorney.
