MOTION TO APPROVE Work Authorization No. CDMS13-22 in accordance with the agreement between Broward County and CDM Smith, Inc., for Continuing Engineering Services for Water Treatment and Raw Water Production Systems to provide deliberately-phased design services and engineering services during construction for District 2A Water Treatment Plant improvements for a maximum not-to-exceed cost of $398,187 and a reimbursable cost of $8,000, for a total cost of $406,187, with a time for performance of 730 consecutive calendar days; and authorize the Mayor and Clerk to execute same. (Commission District 4)

Why Action is Necessary
Board of County Commissioners’ approval is required for work authorizations for consultant services when the amount of the services is more than the award authority of the Director of Purchasing, in accordance with Article 4.4.3 of the agreement.

Summary Explanation/Background
THE PUBLIC WORKS DEPARTMENT/WATER AND WASTEWATER SERVICES RECOMMENDS APPROVAL OF THE ABOVE MOTION.

The Office of Economic and Small Business Development established a cumulative 25% County Business Enterprise (CBE) participation goal for the agreement. CDM Smith, Inc. committed to a 25% CBE participation. Professional consultant services under this agreement are performed through the issuance of work authorizations and CBE participation goals apply to the cumulative total value of the agreement. As a result of the scope of work involved in this work authorization, CDM Smith, Inc. proposed a 0% CBE participation for Work Authorization No. CDMS13-22 due to the specific nature of the electrical work involved in this design. This 0% CBE participation goal for this work authorization was approved by the Office of Economic and Small Business Development. As of September 21, 2017, CDM Smith, Inc. has been paid $1,860,238 with the CBE Subconsultants receiving $360,064, yielding 19.4% participation to date. While this is below the overall goal of 25%, CDM Smith has only earned 37% of the contract value and will have ample opportunity on future work authorizations to meet the agreement goal. Additionally, CDM Smith submitted a plan to the County to insure their stated CBE goals are met. This was accepted by the Office of Economic and Small Business Development in October 2016. In support of their recovery plan, CDM Smith has agreed to a 70% CBE participation on an upcoming Work Authorization. Staff is confident that CDM Smith will meet the cumulative goal of 25% by the completion of this agreement.

On January 14, 2014 (Item No. 33), the Board of County Commissioners approved an agreement between Broward County and CDM Smith, Inc. for Continuing Engineering Services for Water Treatment and Raw Water Production Systems RLI No. R1025211R1 Water and Wastewater Services in a not-to-exceed amount of $1,000,000 per year for two years from the date of the executed agreement, with three one-year extensions which may be executed under the authority of the Director of Purchasing. As of September 21, 2017, twenty work authorizations have been approved for a current agreement value of $2,161,978.

Work Authorization No. CDMS13-22 is a deliberately-phased project for engineering design and regulatory permitting services and engineering services during construction for the replacement and upgrade of the existing medium voltage main electrical switchgear, high service pumps, transfer pump motors starters, and a generator paralleling system at Water Treatment Plant 2A.

This work authorization was negotiated in a Sunshine meeting held on January 27, 2017, attended by representatives of CDM Smith, Inc. and Broward County Water and Wastewater Engineering Division staff. This work authorization was reviewed and approved as to form by the Office of the County Attorney and Risk Management Division.
