MOTION TO CONSIDER enactment of an Ordinance, the title of which is as follows:

AN ORDINANCE OF THE BOARD OF COUNTY COMMISSIONERS OF BROWARD COUNTY, FLORIDA, PERTAINING TO SURFACE WATER MANAGEMENT SYSTEMS; AMENDING SECTION 27-194 OF THE BROWARD COUNTY CODE OF ORDINANCES ("CODE"), PROVIDING EXEMPTION FROM SURFACE WATER MANAGEMENT LICENSING REQUIREMENTS FOR CERTAIN MOBILITY PROJECTS; AND PROVIDING FOR SEVERABILITY, INCLUSION IN THE CODE, AND AN EFFECTIVE DATE.

Why Action is Necessary
A Resolution directing the County Administrator to publish notice of public hearing to consider enactment of the Ordinance was adopted by the Board of County Commissioners at its meeting of November 14, 2017.
What Action Accomplishes
Amends the Code to allow for an exemption from surface water management licensing requirements for certain projects undertaken by the Florida Department of Transportation for Metropolitan Planning Organization sponsored mobility projects.

Summary Explanation/Background
The Florida Department of Transportation and Broward Metropolitan Planning Organization staff have requested an exemption from the procedural requirement to obtain a surface water management license in order to facilitate construction of Broward Metropolitan Planning Organization "Complete Streets" projects. The exemption applies only to the extent the surface water management activity is conducted in full conformance with the provisions of Chapter 27 of the Broward County Code of Ordinances governing water resource management.
