Summary Explanation/Background
THE FINANCE AND ADMINISTRATIVE SERVICES DEPARTMENT AND THE RISK MANAGEMENT DIVISION RECOMMEND APPROVAL OF THE ABOVE MOTION.

On August 30, 2014, a Broward County Transit bus was heading south on Ocean Drive in Hollywood, when it struck a vehicle making a right turn. The bus operator attempted to change lanes to avoid hitting the vehicle, but collided with the vehicle on the driver’s rear side. The claimant, who was a passenger on the bus, is alleging the following injuries: internal derangement of the right knee, chondromalacia patella of the right knee, degeneration of the right medial meniscus and re-injury of the left shoulder. Medical expenses to date total $38,986. The claimant’s health insurance carrier was billed $26,071 and paid $10,736.

A tentative settlement agreement pending Board approval, conditioned on a release of the County from any further obligation, was reached in the amount of $35,000 by the plaintiff’s attorney Susan Kaufman, on behalf of the claimant.

Please note the Concurrence Memorandum was signed by the Office of the County Attorney on November 1, 2017, which is within the 90-day period between settlement and concurrence, as requested by the Board.
