MOTION TO AWARD fixed contract to low bidder, Weekley Asphalt Paving, Inc., for Pembroke Road Construction (Dykes Road to Silver Shores Blvd), Bid No. PNC2115246C1, for the Highway Construction and Engineering Division, in the amount of $6,599,707, which includes an allowance of $25,000, to be substantially completed in 450 calendar days from the Project Initiation Date specified in the Second Notice to Proceed, contingent upon the receipt and approval of insurance/performance and payment guaranty, and authorize the Mayor and Clerk to execute same. (Commission District 8)

Why Action is Necessary
In accordance with the Broward County Procurement Code, Section 21.31.a.4, the Board is required to approve all purchases exceeding $250,000.

Summary Explanation/Background
THE PURCHASING DIVISION AND THE PUBLIC WORKS DEPARTMENT/HIGHWAY CONSTRUCTION AND ENGINEERING DIVISION RECOMMEND APPROVAL OF THE ABOVE MOTION.

The Office of Economic and Small Business Development (OESBD) did not establish County Business Enterprise (CBE) participation goals for this project, because this project is subject to 50% funding from the Florida Department of Transportation (FDOT). Florida Statute 255.0991 prohibits the use of a local preference program based upon business location for project funded 50% or more through State appropriated funding; therefore, OESBD is precluded from establishing CBE goals for this project. In addition, per FDOT guidelines, this contract is not subject to the Broward County Workforce Investment Program (Exhibit 2).

The purpose of this contract is to construct a new four-lane divided roadway on Pembroke Road, from Dykes Road to Silver Shores Boulevard, located within the Cities of Miramar and Pembroke Pines. The project includes designated bicycle lanes and sidewalks on both sides of the roadway, new drainage system, new lighting system, signalization improvement, noise/buffer wall construction, median landscaping, and irrigation improvements.

The procurement carries a 100% performance and payment guaranty. The Purchasing Division has confirmed with the surety company that Weekley Asphalt Paving, Inc. has the capacity to obtain the required guaranty.

The allowances incorporated into this contract, in the not-to-exceed amount of $25,000, is for non-county agency fees and permits. Expenditures under these allowances must be approved by the contract administrator and will be reimbursed at the contractor's actual incurred cost, without markup.

The Highway Construction and Engineering Division reviewed the bid submitted by Weekley Asphalt Paving, Inc. and concurs with the recommendation for award (Exhibit 3). Fifty-one vendor performance evaluations have been completed for Weekley Asphalt Paving, Inc.; the firm has an overall rating of 3.49 out of a possible 5.0. A copy of the vendor performance evaluations is available upon request.

The amounts referenced in this agenda have been rounded to the nearest whole dollar. Vendor payments will be based on the actual invoice amount. The bid tabulation reflects the actual amount of the award, but does not itemize the allowance and line items; however, the total amount for all allowance items is included in the total award amount.

There were no protests filed regarding this procurement.

The bid posted on September 6, 2017 and opened on October 13, 2017; 15 bids were received (Exhibit 1).

Fiscal Impact/Cost Summary:
Funding for this project has been received from the Cities of Miramar and Pembroke Pines and is available in the Engineering Capital Projects Fund. County Incentive Grant monies received from FDOT will be used to reimburse the cities up to 50% of the project costs.
