Broward County and HomeAway.com, Inc. ("HomeAway"), have been negotiating for an extended time in an effort to reach agreement regarding the collection and remittance of tourist development taxes on rental transactions consummated through HomeAway’s online platform(s).
As with the recently approved and substantially similar memorandum of understanding with Airbnb, Inc., the proposed Memorandum of Understanding (attached hereto as Exhibit 1) reserves both parties’ rights, claims, and defenses regarding past-due tourist development taxes, and requires HomeAway to collect and remit the taxes on a prospective basis commencing December 1, 2017.
The effective date of December 1, 2017, allows HomeAway sufficient time to provide notice to affected homeowners and users of the HomeAway internet platform and to make appropriate modifications to the internet platform to implement collection of the tourist development taxes addressed in the agreement.
