MOTION TO AWARD fixed contract to low bidder, Weekley Asphalt Paving, Inc., for Bid No. T2114125C1, Intersection Improvements in Coral Springs, Miramar and Pembroke Pines for Highway Construction and Engineering Division, in the amount of $833,445, which includes allowances in the amount of $4,500, to be substantially completed in 98 calendar days from the Project Initiation Date specified in the Second Notice to Proceed, contingent upon the receipt and approval of insurance/performance and payment guaranty, and authorize the Mayor and Clerk to execute the same. (Commission Districts 3 and 8)

Why Action is Necessary
In accordance with the Broward County Procurement Code, Section 21.31.a.4, the Board is required to approve all purchases exceeding $250,000 per annum or $400,000 in a multi-year period.

Provides for a fixed contract for all labor, materials, equipment and services for the intersection improvements in Coral Springs, Miramar and Pembroke Pines.

Summary Explanation/Background
THE PURCHASING DIVISION AND THE PUBLIC WORKS DEPARTMENT/HIGHWAY CONSTRUCTION AND ENGINEERING DIVISION RECOMMEND APPROVAL OF THE ABOVE MOTION.

The Office of Economic and Small Business Development (OESBD) established a County Business Enterprise (CBE) participation goal of 15% for this contract. Weekley Asphalt Paving, Inc. has committed to 15.40% CBE participation, which has been reviewed and approved by the OESBD (Exhibit 2).

The purpose of this contract is to provide all labor, materials, equipment and services for intersection improvements in the cities of Coral Springs, Miramar, and Pembroke Pines.

This procurement carries a 100% performance and payment guaranty. The Purchasing Division has confirmed with the surety company that Weekley Asphalt Paving, Inc. has the capacity to obtain the required guaranty.

The allowances incorporated into this contract, in the amount of $4,500, are for permit and inspection fees. Expenditures under these allowance items must be approved by the contract administrator and will be reimbursed at the contractor’s actual incurred cost, without mark-up (Exhibit 1).

There was no protest or appeal filed regarding this procurement.

The Highway Construction and Engineering Division has reviewed the bid submitted by Weekley Asphalt Paving, Inc. and concurs with the recommendation for award (Exhibit 3). Thirty-nine vendor performance evaluations have been completed for Weekley Asphalt Paving, Inc., with an average of 3.41 out of a possible rating of 5.0. Copies of the vendor performance evaluations are available upon request.

The amounts referenced in this agenda have been rounded to the nearest whole dollar. Vendor payments will be based on the actual total bid amount. The bid tabulation reflects the actual amount of the award.

In accordance with the Broward County Workforce Investment Program, Administrative Code, Section 19.211, these services are subject to the Workforce Investment Program. Weekley Asphalt Paving, Inc. has agreed to be bound to the contractual obligations of the Workforce Investment Program.

There was no protest or appeal filed regarding this procurement.

The bid validity for this project expired on August 15, 2017. Weekley Asphalt Paving, Inc. agreed to extend its bid validity through December 14, 2017.

The bid posted on April 28, 2017 and opened on June 14, 2017; two bids were received with two declinations (Exhibit 1).
