MOTION TO ADOPT Resolution No. 2017-525 amending the Administrative Code to revise the fee schedule for proposed amendments to the Broward County Land Use Plan, amendments and waivers to the Broward County Trafficways Plan, recertifications of municipal land use plans, requests for written platting determinations, and requests for written land use interpretations/confirmations.

A RESOLUTION OF THE BOARD OF COUNTY COMMISSIONERS OF BROWARD COUNTY, FLORIDA, RELATING TO THE BROWARD COUNTY PLANNING COUNCIL; AMENDING SECTION 40.5 OF THE BROWARD COUNTY ADMINISTRATIVE CODE ("CODE"); AMENDING PROCESSING FEES FOR THE BROWARD COUNTY PLANNING COUNCIL; AND PROVIDING FOR SEVERABILITY, INCLUSION IN THE CODE, AND AN EFFECTIVE DATE.

VOTE: 8-1.  Commissioners Geller and Holness voted in the affirmative telephonically.  Commissioner LaMarca voted no. 
Why Action is Necessary
The fee schedule revision is necessary to reflect a 2012 fee study conducted in coordination with the Broward County Office of Management and Budget, inclusive of salary increases and the cost of inflation since that time. Due to the recovering economy, the Planning Council maintained the fee structure adopted in 2010, and did not pursue the fee adjustments proposed by the 2012 study.
What Action Accomplishes
The Resolution revises the Planning Council fee schedule as outlined in Section 40.5a of the Broward County Administrative Code (See Exhibit 1).

Summary Explanation/Background
At its meeting of August 24, 2017, the Planning Council voted to recommend to the Broward County Board of County Commissioners that the fees charged for processing Broward County Land Use Plan amendments, Broward County Trafficways Plan amendments and waiver requests, recertification of municipal land use plan amendments, and requests for written platting determinations and interpretation/confirmation letters be revised to reflect the associated increase in cost. 

It is noted that the processes were studied in 2012, but the fees have not been updated since June, 2010 based on the 2008 study. The proposal reflects the results of the 2012 study, inclusive of annual wage and CPI variations since that time. See Exhibit 2.

The purpose of this agenda item is to consider revisions to the referenced fee schedule as follows:

The action by the Planning Council included a fee waiver for land use plan amendments with a committed affordable housing component and a request for annual fee increases based on wage and CPI variations.

Fiscal Impact
Fiscal Impact/Cost Summary:
The proposed fee update will result in an increase of fees collected from applicants, except for Trafficways Plan amendments and waivers. The actual impact will be based on the number of applications and requests received by the Planning Council.
