A. MOTION TO APPROVE Joint Participation Agreement between the Florida Department of Transportation (FDOT) and Broward County in the amount of $3,400,000 for expenses relating to construction of the Slip 1 (Berths 9 and 10) Widening Project at Port Everglades, requiring a 50% match of $3,400,000 from Broward County, effective upon execution by FDOT through December 31, 2022; authorize the County Administrator or designee to take necessary administrative and budgetary actions; and authorize the Mayor and Clerk to execute same.

B. MOTION TO DELEGATE authority to the Port Everglades Chief Executive/Port Director to approve any future amendments or supplements to the subject agreement, limited to extending the term or changes to standards and specifications and provided that the amendment or supplement does not require additional funding by Broward County.

Summary Explanation/Background
THE PORT EVERGLADES DEPARTMENT RECOMMENDS APPROVAL.

This item supports the Broward County Board of County Commissioners' (Board) Value of "Ensuring economic opportunities for all people and businesses in Broward" and Goal to "Increase the economic strength and impact of revenue-generating County enterprises balancing economic, environmental, and community needs."

The Slip 1 (Berths 9 and 10) Widening Project in the Northport area at Port Everglades is intended to widen the existing slip from 300 feet to 450 feet to accommodate larger petroleum tank vessels at the port. On February 7, 2017 (Item No. 10), the Board approved a deliberately phased Agreement between Broward County and HDR Engineering, Inc., for Design and Engineering Services - Port Everglades Slip 1 Expansion for a total contract amount of $6,347,506, which includes a maximum not-to-exceed amount of $5,949,404 for basic services and $398,102 for reimbursable expenses for planning, programming, design, and other construction-related activities for the project.

The Florida Department of Transportation (FDOT) has approved the disbursement of $3,400,000 million in Fiscal Year 2017/2018 Florida Seaport Transportation and Economic Development (FSTED) 311 F.S. grant funds for the construction of the Slip 1 (Berths 9 and 10) Widening Project through this Joint Participation Agreement (JPA), which requires matching funds from Broward County in the amount of $3,400,000 million for project costs. With the execution of this JPA, total project costs are $6,800,000, with FDOT providing 50% of the funding. This JPA provides a state grant contribution towards funding the construction of the project. A separate agenda item addresses additional state grant funding to complete the design of the project.  The current estimate for the construction cost is $83,000,000.

Completion of this project is needed to accommodate larger petroleum tank vessels, resulting in increased safety, additional capacity and throughput potential. A requirement of this funding is to execute the JPA between FDOT and Broward County prior to disbursement. The JPA is written in the standard FDOT format and has been reviewed by the Port Everglades Risk Manager and approved as to form by the Office of the County Attorney. FDOT will execute the JPA after County approval.
