MOTION TO DESIGNATE South Florida Symphony Orchestra, Inc. (SFSO), a Cultural Institution Program, as defined by the Broward County Administrative Code, Chapter 29, Part II, Section 29.16 (c.)(1.), Cultural Institution Program (CINP), and recommended by the Broward Cultural Council (Council). (Commission District 7)

Why Action is Necessary
Designation as a CINP must be approved by the Broward County Board of County Commissioners (Board) pursuant to Broward County Administrative Code, Chapter 29, Part II, Section 29.16 (c.)(1.), upon recommendation by the Council.

Summary Explanation/Background
CULTURAL DIVISION RECOMMENDS APPROVAL OF THE ABOVE MOTION.

This item supports the Board’s value of "Cultivating community culture, arts, recreation and life-long learning" and goals relating to providing diverse artistic, cultural, educational and historical amenities and programs that contribute to a vibrant, multi-cultural and economically-viable community.

On May 26, 2017, the Cultural Division received a CINP Designation Request (Exhibit 1) from SFSO for eligibility to apply to the CINP for funding beginning in the County’s Fiscal Year 2019, which will commence October 1, 2018.

Pursuant to the Broward County Administrative Code, Chapter 29, Part II, Section 29.16 (c.)(1.), in order to be eligible to apply for funds under the CINP, a non-profit organization must meet the following criteria:

1. Its primary mission is cultural.
2. It has tax-exempt status under Section 501(c)(3) of the Internal Revenue Code.
3. It has a governing board, at least one-half (½) of whom reside in Broward County or, a designated Cultural Institution Program which is also designated a Regional Investment Program and which meets residency requirements for a Regional Investment Program, and which meets regularly and operates under a set of bylaws
4. Its principal office address, as recorded in the Secretary of State's office, is in Broward County with a minimum of one full-time staff position in that office.
5. It has a significant, continuing contribution to the artistic, cultural, and economic life of Broward County.
6. It has presented a regular season of cultural exhibitions or performances open to the general public for an interrupted 10-year period.
7. It has a minimum annual operating budget of $1,000,000.00 exclusive of tangible collections, capital, and/or endowment funds.
8. It has a full-time paid professional staff.
9. It has the ability to match funds dollar-for-dollar.
10. It has a significant countywide or regional impact.
11. It has a sustained level of artistic excellence.
12. It receives major Broward community audience support through subscriptions and/or membership, earned income and fund-raising activities.
13. It demonstrates long-term fiscal responsibility.

At the October 5, 2017 Council meeting, it was determined that SFSO meet all the requirements listed in the Administrative Code, and the Council recommended approval of the Designation Request. The organization has been in existence since 1997, has annual revenues of $1,168,528 based on its audited June 2016 financial statements, and SFSO has played an important role for the arts and culture in Broward County by providing a variety of programming and exhibitions that reach out to the County’s diverse population and unique needs. The amounts for each successful applicant is approved by the Board at the final public budget hearing based on the recommended amount of the Council.

Funding for the CINP grant program will come from the General Fund revenue. On a funds-available basis, the grant award in this category may range from $110,000 - $310,000. For Fiscal Year 2018, the grant awards ranged from $110,000 to $127,000.

There are currently eight organizations designated as a CINP: Bonnet House, Inc.; Hollywood Art and Culture Center, Inc.; Museum of Discovery and Science, Inc.; Nova Southeastern University, Inc. on behalf of its Museum of Art Division; Opera Guild Inc. of Fort Lauderdale; Symphony of the Americas, Inc.; The Broward County Film Society, Inc.; and Young At Art of Broward, Inc.

If designated as a CINP, the organization will no longer be eligible to apply in the General Operating Program; however, it may apply for a Cultural Tourism Program (a project grant) and the Tourist Development Tax Capital Challenge Grant Program.

Fiscal Impact/Cost Summary:
No fiscal impact. The Designation only qualifies SFSO to apply for grant funding in the CINP. A grant review panel will recommend funding to the Council who then recommends the funding amount to the Board.
