Summary Explanation/Background
On August 8, 2016, Plaintiff Patricia Hachmann was crossing Broward Boulevard at its intersection with Northeast 3rd Avenue within a crosswalk, and was struck by a transit bus. The Plaintiff claims to have sustained multiple injuries including a total left hip replacement, fractured ribs, collapsed lung, and nerve damage to her right arm. She has agreed to release Broward County from all claims arising from this accident in exchange for $169,000, inclusive of attorney's fees and costs, subject to approval by the Board of County Commissioners.
 
A loss of consortium and a loss wage claim were also brought by her husband, Jon Hachmann. These claims were resolved within the settlement authority of the Office of the County Attorney in the total amount of $15,000, inclusive of fees and costs, and subject to the settlement of Patricia Hachmann's claim.
 
If this settlement is approved by the Board, Broward County will pay the Plaintiffs a total sum of $184,000, inclusive of fees and costs. Subject to Board approval, the Plaintiffs have executed a Complete Settlement of Claim and Release, releasing the County of any and all claims in connection with the August 8, 2016, accident.
 
The Risk Management Division concurs with and recommends approval of this settlement.

Fiscal Impact/Cost Summary:
The source of funds is the County's general liability self insurance fund. Agencies of the County pay annual premiums into the fund based upon the number of their employees and five-year claims history.
