MOTION TO APPROVE Joint Participation Agreement (JPA) by and between Broward County and Florida Turnpike Enterprise (FTE) to share responsibility for Florida Department of Environmental Protection (FDEP) National Pollutant Discharge Elimination System (NPDES) Municipal Separate Storm Sewer System (MS4) Permit No. FLS000016-004 through January 4, 2023, for a total payment to the County of $16,550 and authorize the Mayor and Clerk to execute same.

Summary Explanation/Background
THE ENVIRONMENTAL PROTECTION AND GROWTH MANAGEMENT DEPARTMENT AND THE ENVIRONMENTAL ENGINEERING AND PERMITTING DIVISION RECOMMENDS APPROVAL OF THIS MOTION.

This action supports the Board's value of encouraging investments in renewable energy, sustainable practices and environmental protection: Goal 3: Increase water quality protection efforts and lead creative approaches to water storage and aquifer recharge, as well as diversification of water supplies, regionally. Approving the JPA achieves the goal of increasing water quality protection efforts by ensuring the requirements of the NPDES MS4 Permit are met.

The Board approved a similar agreement with FTE to cost share the requirements of the previous NPDES MS4 Permit on May 7, 2013 (Item No. 27). This agreement will authorize cost sharing of the technical activities required to fund the current NPDES MS4 Permit, which expires on January 4, 2022.

NPDES MS4 Permit No. FLS000016-004 was issued pursuant to 40 CFR 122.26 and Section 403.0885 F.S. on January 5, 2017, to authorize the County and its co-permittees to discharge to waters of the State in accordance with the approved stormwater management programs, effluent limitations, monitoring requirements and other provisions as set forth in the five-year permit.

FTE desires to obtain the services of Broward County to develop and implement surface water monitoring and pollution prevention programs, to identify sources of illicit discharges into storm drainage systems, to determine if high risk facilities are in compliance with all appropriate aspects of the stormwater program, to develop an annual report on the accomplishments of the co-permittees, and to conduct other similar activities pursuant to NPDES regulations.

This JPA has been reviewed and approved as to form by the office of the County Attorney.
