PUBLIC WORKS DEPARTMENT/HIGHWAY AND BRIDGE MAINTENANCE DIVISION RECOMMENDS APPROVAL.
On March 14, 2006 (Item No. 4), the Board of County Commissioners approved a tri-party agreement between Broward County, the Florida Department of Transportation (FDOT), and CSX Transportation, Inc. (CSX) for maintenance of the railroad crossing along the South Florida Rail Corridor at Copans Road, a Broward County road within the City of Pompano Beach. Under the agreement, Broward County became responsible for maintenance costs of the road outside of the railroad ties; and CSX became responsible to perform the maintenance of the crossing.
Presently, FDOT is planning to upgrade the crossing signals at the Copans Road rail crossing. In 2015, FDOT contracted with the South Florida Regional Transit Authority (SFRTA) to maintain rail crossings in South Florida along the South Florida Rail Corridor. As a result, FDOT is requiring a new agreement with Broward County and SFRTA to replace the prior agreement between FDOT, CSX and Broward County. Under the proposed replacement agreement, FDOT will fund the crossing signal upgrade cost, SFRTA will perform the upgrade work, and Broward County and SFRTA will equally share the operation and maintenance costs of the new crossing signals. Future modification and rehabilitation costs outside of the railroad ties will continue to be the sole responsibility of Broward County.
The proposed agreement is based on FDOT's standard form agreement but has been modified to include the County's comments. Approval of this agreement will allow FDOT and SFRTA to upgrade the railroad crossing traffic signals at Copans Road and conduct future, periodic maintenance.
This Agreement has been reviewed and approved as to form by the Office of the County Attorney, and the Risk Management Division.
