MOTION TO AUTHORIZE County Administrator to take all administrative and budgetary actions necessary to execute the Florida Department of Highway Safety and Motor Vehicles (DHSMV) Memoranda of Understanding and related documents required for chauffeur registration background checks; and to designate the Environmental and Consumer Protection Division Director to serve as the County Administrator's designee in executing these and any other documents associated with maintaining access to the DHSMV information necessary for these background checks, subject to review by the Office of the County Attorney.

Summary Explanation/Background
THE ENVIRONMENTAL PROTECTION AND GROWTH MANAGEMENT DEPARTMENT AND THE ENVIRONMENTAL AND CONSUMER PROTECTION DIVISION RECOMMEND APPROVAL OF THE ABOVE MOTION.

Approval of this item permits the County Administrator's designee to execute MOUs and related agreements between Broward County and the Florida Department of Highway Safety and Motor Vehicles (DHSMV) to permit access to DHSMV data for  chauffeur registration background checks.

Section 22½-8, Chapter 22½ - Motor Carriers, of the Broward County Code of Ordinances requires background checks prior to issuing a Broward County chauffeur's registration. The background check includes a review of driving records. Driving record information is obtained from the DHSMV under a Memorandum of Understanding (MOU). The last MOU was executed in October 2014 for a three year period, ending October 31, 2017 (since extended to November 30, 2017). During this time, DHSMV has changed their protocols to require several additional agreements including the Data Access MOU, an MOU Certification of internal controls, Data Access Application, Data Access Questionnaire, Data Access Exempt Information Request, and a Driver and Vehicle Information Database System (DAVID) MOU (Exhibits 1 - 6).

To process these documents and expedite any future additional requests or revisions associated with obtaining DHSMV information, signing authority is being requested for the ECPD Director, through the County Administrator, subject to review by the Office of County Attorney.
