A.  MOTION TO ADOPT Resolution No. 2017-521 to vacate two drainage maintenance easements lying within Tract A of the Delta Pompano plat, located at 1951 North Powerline Road in Pompano Beach at no cost to the County; Petitioner: Waste Management Inc. of Florida; Agent: Craven Thompson and Associates, Inc.; Application for Vacation and Abandonment: 2017-V-03. (Commission District 2)

VOTE: 8-0.  Commissioners Geller and Holness voted in the affirmative telephonically.  Commissioner Udine abstained from voting.

B.  MOTION TO ADOPT Resolution No. 2017-522 accepting canal maintenance easement at 1951 North Powerline Road in Pompano Beach from Waste Management Inc. of Florida at no cost to the County; and authorize recordation of same. (Commission District 2)

Why Action is Necessary
A.  Board of County Commissioners' approval is required to vacate drainage maintenance easements pursuant to Broward County Administrative Code, Chapter 25.

B.  Board of County Commissioners' approval is required to accept an interest in real property pursuant to Broward County Administrative Code, Section 6.23.
What Action Accomplishes
A.  Provides the property owner, Waste Management Inc. of Florida, with clear unencumbered title to the lands in the areas affected by this vacation. 

B.  Provides Broward County with a canal maintenance easement to maintain a canal on the south side of Tract A, west of Powerline Road.

Summary Explanation/Background
THE PUBLIC WORKS DEPARTMENT/FACILITIES MANAGEMENT DIVISION/REAL PROPERTY SECTION AND WATER AND WASTEWATER SERVICES RECOMMEND APPROVAL OF THE ABOVE MOTIONS.

MOTIONS A AND B: The two 20-foot-wide drainage maintenance easements lie within Tract A of Delta Pompano plat, as recorded in Plat Book 179, Page 67 of the Public Records of Broward County and is located at 1951 North Powerline Road in Pompano Beach in Section 28, Township 48 South, Range 42 East. The Folio Number affected by this proposed vacation is 4842-28-28-0010.

Vacating these drainage maintenance easements will provide clear and unencumbered title to the property owner, Waste Management Inc. of Florida.

The vacation application and fee were received and the fee was deposited by the County's Real Property Section on March 31, 2017.

Review of this application by the County Attorney's Office, applicable Broward County agencies and utility companies was completed on July 27, 2017. Water Management Division of Broward County Water and Wastewater Services approved the vacation of these two drainage maintenance easements on the condition that Waste Management Inc. of Florida grant to Broward County a 15-foot-wide canal maintenance easement along the south side of Tract A from the west right-of-way line of Powerline Road, extending west for a distance of 1,226.86 feet for the maintenance of an existing canal which is presented to the Board of County Commissioners for approval and acceptance as Motion B.  No other reviewing agency has indicated that the easements are currently used, nor is there a plan for future use.

The Board of County Commissioners approved the Resolution Authorizing Public Hearing on October 10, 2017 (Item No. 6).

The vacation application and canal maintenance easement have been reviewed and approved as to form by the Office of the County Attorney.

Fiscal Impact/Cost Summary:
Revenue was collected and deposited in the amount of $1,200 as a vacation application fee.

Vacating these drainage maintenance easements and the acceptance of the canal maintenance easement will have little or no effect on ad valorem taxes.
