MOTION TO APPROVE First Amendment to Work Authorization No. CDMS13-16 in accordance with the agreement between Broward County and CDM Smith Inc. for Continuing Engineering Services for Water Treatment and Raw Water Production Systems, RFP No. R1025211R1, to provide for deliberately-phased engineering services during construction for the District 3A Potable Water Booster Station in the amount of $190,779, consisting of $163,954 for not-to-exceed costs, $25,000 for optional additional services, and $1,825 for reimbursable expenses, for a revised potential total of $406,687, an increase in time for performance of 330 days for a total time for performance of 780 days; and authorize the Mayor and Clerk to execute same. (Commission District 7)

(Per the Tuesday Morning Memorandum, Exhibit “A-1” was distributed as Additional Material by the Public Works Department.  That exhibit is included in the item for purposes of the Board’s consideration.)


ACTION:  (T-10:45 AM)  Approved with the Yellow-Sheeted Additional Material, dated Tuesday, November 7, 2017, submitted at the request of the Public Works Department.

Why Action is Necessary
Board of County Commissioners’ approval is required for amendments to contracts exceeding the award authority of the Director of Purchasing, in accordance with the Broward County Procurement Code, Section 21.94.a.
What Action Accomplishes
Provides for additional consultant engineering services during construction for the installation of a potable water re-pumping and re-chlorination facility to serve the Fort Lauderdale-Hollywood International Airport from the District 3A water distribution system.

Summary Explanation/Background
THE PUBLIC WORKS DEPARTMENT/WATER AND WASTEWATER SERVICES RECOMMENDS APPROVAL OF THE ABOVE ACTION.

The Office of Economic and Small Business Development (OESBD) established a County Business Enterprise (CBE) participation goal for the Agreement of 25%. A County Business Enterprise (CBE) participation goal of 2.82% was established for this Work Authorization. For this First Amendment to the Work Authorization, CDM Smith Inc. has committed to 2.82% CBE participation. As of May 2017, CDM Smith, Inc. has been paid in total $1,339,301 with $335,706 paid to CBE firms, yielding 25.1% participation. CDM Smith, Inc. indicates that they will maintain their original 25% CBE participation with the additional services contained in this Amendment; OESBD has reviewed the Amendment (Exhibit 1) and is in concurrence with current participation efforts (Exhibit 2). Work Authorization No. CDMS13-16 provided for engineering design services for a new potable water booster pump facility in the District 3A water service area. The new potable water booster pump facility will provide increased potable water system pressure and disinfection that will benefit the Fort Lauderdale-Hollywood International Airport during emergency events.

This deliberately-phased First Amendment to Work Authorization No. CDMS13-16 in the amount of $190,779 provides for engineering services during construction.

One Sunshine meeting was held to negotiate this Amendment on July 8, 2016 to establish the scope and fee for engineering services during construction for this Amendment. This meeting was attended by representatives of CDM Smith, Inc. and Broward County Water and Wastewater Engineering Division staff.

This Amendment has been reviewed and approved as to form by the Office of the County Attorney and Risk Management Division. All dollar amounts referenced in this agenda item have been rounded to the nearest dollar.
