Requested Action
MOTION TO APPROVE Terminal Building Lease Agreement between Broward County and Emirates, Inc., for the lease and use of Airline Ticket Office space in Terminal 3, at Broward County's Fort Lauderdale-Hollywood International Airport, effective on December 19, 2017, and terminating on the fifth annual anniversary of the effective date; and authorize the Mayor and Clerk to execute same.

VOTE: 9-0.  Commissioners Geller and Holness voted in the affirmative telephonically. 
Why Action is Necessary
Chapter 2, Section 2-40 (a) of the Broward County Code of Ordinances, requires that the Broward County Board of County Commissioners ("Board") authorize any commercial activities or occupation of any portion of the Airport.
What Action Accomplishes
Provides for Emirates, Inc. ("Emirates"), to occupy space in Terminal 3 in accordance with the provisions of the Terminal Building Lease Agreement ("TBLA") between Broward County and Emirates.

Summary Explanation/Background
THE AVIATION DEPARTMENT RECOMMENDS APPROVAL OF THE ABOVE MOTION.

This action provides for Emirates to lease space in Terminal 3 at Broward County's Fort Lauderdale-Hollywood International Airport ("FLL") and to authorize the CEO/Director of Aviation to execute any further amendments relating to the relocation, addition or reduction of leased space.
 
On December 19, 2016, the CEO/Director of Aviation approved a Short Term Agreement between Broward County and Emirates effective upon execution and terminating on December 18, 2017. The Short Term Lease Agreement provided for the rental of office space in Terminal 3.  Emirates provides weekly services from FLL to the United Arab Emirates.

The proposed TBLA will be effective on December 19, 2017, and will terminate on the fifth annual anniversary of the Effective Date. The TBLA provides for Emirates to lease 603 square feet of Airline Ticket Office space in Terminal 3, arrival level.

The proposed TBLA has been reviewed and approved as to form by the Office of the County Attorney and the Risk Management Division.

Fiscal Impact
Fiscal Impact/Cost Summary:
The estimated annual rental amount for the TBLA is $134,246 plus applicable sales taxes and may be adjusted annually according to the rates as established in Chapter 39 of the Broward County Administrative Code. 

Emirates is current on all monies due to the County.
