Amendments to interlocal agreements for BRP projects previously approved by the Board on June 10, 2014, require approval by the Board of County Commissioners.

Action approves amendment to ILA which allows for the project to be completed in an extended timeframe, due to unforeseen plat restriction issues and off-site water storage requirements which arose in the design process.

Summary Explanation/Background
THE ENVIRONMENTAL PROTECTION AND GROWTH MANAGEMENT DEPARTMENT AND THE HOUSING FINANCE AND COMMUNITY REDEVELOPMENT DIVISION RECOMMEND APPROVAL OF THE ABOVE MOTION.

This item supports the Board’s Value of offering sustainable, compatible, innovative housing options for all income-levels, including integrated supportive housing and rapid-rehousing: Goal 1: Facilitate a regional approach to growth and redevelopment through coordination and collaboration at the federal, state and local levels; Goal 2: Strengthen stakeholder partnerships to increase the availability of affordable housing of all types (e.g. rental, purchase, supportive, etc.), countywide, in every community; and Goal 3: Develop, through effective community collaboration, neighborhoods and communities incorporating intermodal connectivity, while integrating energy efficiency community resilience, and other livability standards and initiatives.

On November 12, 2013, the Board of County Commissioners (Board) approved the first round of 11 projects funded through the Broward Redevelopment Program (BRP). Among those 11 projects, was one for the City of Tamarac, known as Tamarac Village. It is a public improvement project to install utilities, drainage, roadway improvements, sidewalks and landscaping on Northwest 57th Street, bounded by Northwest 94th Avenue and Pine Island Road, for an amount not to exceed $1,500,000.

On June 10, 2014, the Board approved the Interlocal Agreement (ILA) for the project.

Subsequent to the execution of the Tamarac Village Infrastructure ILA, the City has run into delays related to offsite drainage requirements for the Project. According to their letter requesting an ILA extension, dated April 7, 2017 (Exhibit 2), the City states they entered into a developer agreement in October 2015, and since then;

…"the City and developer worked on solutions to certain plat restrictions affecting two parcels contained within the Property. These solutions required a quiet title action that was recently resolved as well as determination of offsite water quality storage issues that were required to be resolved as a precursor to the submittal of a site plan.” The City is confident the infrastructure improvements can be completed within extension period (See Exhibit 3). 

Since last year, County staff and City representatives have been discussing the delays surrounding the Project and the ILA amendment request. City staff has stated the scope and funding aspects of the project remain the same. If approval of the recommended ILA Amendment is granted by the County (See Exhibit 1), this will extend the ILA term for two years, or until October 31, 2019.

The Project will continue to implement the Broward Redevelopment Program objectives of promoting economic development, job creation and reducing blighting conditions. Therefore, County staff recommends approval of the above MOTION. However, please note that the County Environmental Protection and Growth Management staff will support no additional extensions to the ILA.
