A. MOTION TO DRAW categories for appointment of members to the Medical Marijuana Advisory Board (MMAB).

ACTION:  (T-12:44 PM)  The Board drew categories for appointments of members to the Medical Marijuana Advisory Board (MMAB).  Staff drew categories on the behalf of Commissioner Holness and Mayor Sharief.  (Refer to minutes for full discussion.)

B. MOTION TO DISCUSS and provide direction to staff regarding whether MMAB at-large appointments shall be part of the rotation process or selected through the at-large nomination process.

ACTION:  (T-12:58 PM)  Following Board discussion, the Board directed staff that the Medical Marijuana Advisory Board (MMAB) at-large appointments will be selected through the at-large nomination process.  (Refer to minutes for full discussion.)

A categorical draw is necessary to comply with membership requirements of the MMAB.

Summary Explanation/Background
MOTION A
On September 14, 2017, the Board of County Commissioners created the Medical Marijuana Advisory Board (MMAB). The MMAB is comprised of 12 members, of the 12 members, nine members are District specific appointments and three are at-large positions.

Specific categories call for a categorical draw and this item provides the draw for the following members:
  • One person with knowledge of the medical marijuana industry outside Florida
  • One person with knowledge of the Broward County public and private educational system and the Broward County School Board
  • One representative from the Broward Sheriff's Office.
  • Two representatives, nominated by academic institutions, with appropriate scientific knowledge and experience in issues related to medical marijuana.
  • One representative from the hospital districts in Broward County
  • Two representatives from the business and economic development community
  • One representative from the State of Florida Department of Health, Broward County

Each Commissioner will draw one "position" out of the envelope containing slips of paper that will indicate the category for appointment. Each commissioner will write his or her name on the slips drawn to assign the position to the appropriate Commission District. Subsequently, staff will announce the categorical selection publicly and the Board will vote to accept the categorical draw.  

After the draw is concluded, staff will prepare and deliver a chart containing the final results of the categorical draw. Consistent with the Commission's policy, categories drawn by each Commissioner will be permanently assigned to the Commission District for future appointments until the Commission holds a new categorical draw for the MMAB.  Once categories are selected, appointments to fill those positions will be handled in the same manner as other district board appointments.

MOTION B
The at-large rotation process was adopted at the June 5, 2001 County Commission meeting. A list of at-large advisory board positions, which are either vacant, the term is ending soon, or the term has expired, is prepared by the Office of Intergovernmental Affairs and Professional Standards (OIAPS). The list affords a Commissioner the opportunity to nominate an individual to serve on an available board.  The list is rotated among Commissioners every 15 days.  Generally, if the Commissioner in possession of the list picks an individual during the fifteen day period, his or her staff will afterward send an agenda item and a resume to the OIAPS Boards Administrator.  In turn, the agenda item and resume are sent to the County Attorney's Office (CAO) to complete the vetting process. 

Once a Commissioner selects a specific board on the rotation list, that board is deleted from the list, new positions are added, and the updated list is sent to the next Commissioner on the rotation.  Should a board position go through an entire rotation without being selected to be filled, the available position is automatically placed in the "At-Large Available to all Commissioners" list.  To notify Commissioners of the available board position, OIAPS places an item on the Board's agenda entitled "Motion to Accept Nominations."  Subsequent to the County Commission approving such item, any Commissioner may nominate qualified individuals for an at-large appointment from the At-Large Available to All Commissioners list. 

Instead of designating an advisory board's at-large appointments to follow the rotation process, the Board may determine that an advisory board's vacant or otherwise available positions will automatically be placed on the At-Large Available to all Commissioners list.  OIAPS will similarly notify the Board of the advisory board positions that are available for appointment through a Motion to Accept Nominations, after which any Commissioner may seek to nominate a qualified individual to the position.  

This item seeks the Board's direction as to which process should be used to fill vacant at-large appointments to the MMAB.
