MOTION TO AWARD open-end contract to low responsive responsible bidder, Mills Electric Service, Inc. for Electrical Maintenance and Repair, Bid No. Y2113492B1, for Water and Wastewater Services, in the two-year estimated amount of $2,415,209, which includes allowances in the amount of $612,000, and authorize the Director of Purchasing to renew the contract for one two-year period, for a four-year potential estimated amount of $4,830,418. The initial contract period begins on the date of award and terminates two years from that date.

Why Action is Necessary
In accordance with the Broward County Procurement Code, Section 21.31.a.4, the Board is required to approve all purchases exceeding $250,000 per annum or $400,000 in a multi-year period.

Summary Explanation/Background
THE PURCHASING DIVISION AND THE PUBLIC WORKS DEPARTMENT/WATER AND WASTEWATER SERVICES RECOMMEND APPROVAL OF THE ABOVE MOTION.

The Office of Economic and Small Business Development Division (OESBD) established a County Business Enterprise (CBE) goal of 19% for this contract. Mills Electric Service, Inc. committed to 19% CBE participation, which has been reviewed and approved by the OESBD (Exhibit 2).

The purpose of this contract is to provide electrical maintenance and repair services for electrical components and equipment, including drawbridges, within the County. The scope of services includes inspection, adjustment, fabrication, calibration, testing and repair.

This procurement carries a 100% performance and payment bond for any individual work order of $200,000 or greater. The Purchasing Division has confirmed with the surety company, that Mills Electric Services, Inc. has the capacity to obtain the required bond.

The allowance items incorporated into this contract in the two-year amount of $612,000 include: $500,000 for parts and materials; $7,000 for non-Broward County permits and fees and security badging; $100,000 for specialty subcontractors; and $5,000 for the removal and disposal of hazardous materials. Expenditures under these allowance items must be approved by the contract administrator and will be reimbursed at the contractor's actual cost without mark-up.

In accordance with the Living Wage Ordinance, No. 2008-45, as amended, Section 26-101(f), these services are subject to the Living Wage. Mills Electric Service, Inc. has committed to pay its workers at least the minimum requirements of the Living Wage Ordinance for the duration of this contract.

In accordance with the Broward County Workforce Investment Program, Broward County Administrative Code, Section 19.21, these services are subject to the Workforce Investment Program. Mills Electric Service, Inc. has agreed to be bound to the contractual obligations of the Workforce Investment Program.

The Director of Purchasing has determined the low bidder, Francis Uriel Electric, Inc., to be non-responsive to the bid requirements; the bidder did not meet the qualifications as stated in the bid documents.

Water and Wastewater Services reviewed the bid submitted by Mills Electric Service, Inc. and concurs with the recommendation for award (Exhibit 3). Twenty-one performance evaluations were completed for Mills Electric Service, Inc.; the firm has an overall rating of 3.82 out of a possible 5.0. Copies of the performance evaluations are available upon request.

There was no protest or appeal filed regarding this procurement. 

Incumbent: Mills Electric Service, Inc. Contract Title: Electrical Maintenance and Repair Services. Contract No. Y1109311B1, Contract Term: June 4, 2013 to September 1, 2017 Expenditures to-date: $2,744,804.

On June 4, 2013 (Item No. 67), the previous contract was awarded by  the Board. The contract term started on June 4, 2013 and ended on June 3, 2017. The County then invoked the 90-day contract extension from June 4, 2017 to September 1, 2017, as allowed by the solicitation document.

Interim Contract No. Y2113492BX with Mills Electric Service, Inc. in the amount of $200,000, was approved by the Director of Purchasing utilizing the same pricing, terms and conditions of Bid No. Y2113492B1, in order to provide the referenced services from September 2, 2017, until the date of award.

There was no protest or appeal filed regarding this procurement.

The bid validity for this project expired on September 21, 2017. Mills Electric Service, Inc. agreed to extend the bid validity through October 31, 2017, for Bid No. Y2113492B1.

The bid posted on May 4, 2017 and opened on May 24, 2017, two bids were received with one declination (Exhibit 1).
