A Motion to Consider Rescission is the first required step for the possible rescission of the Board action.

Summary Explanation/Background
This Item addresses the Board's June 13, 2017, vote on Item 67 on that agenda. The Item requested that the Board approve the final ranking of qualified firms to perform external audit services. The Board action directed staff to allow firms the opportunity to file a bid protest. If the protest was unsuccessful, the Board action directed staff to proceed with negotiations with RSM USA LLP, the top-ranked firm. If the protest was successful, staff was directed to return the matter to the Board for its further consideration and direction.

The second ranked firm, S. Davis & Associates, P.A., filed a protest. The protest was denied, but the firm's appeal of that denial remains pending. If the appeal is successful, the Board has already directed that this matter be returned to the Board for its consideration and direction. However, even if the appeal is unsuccessful, the Board's direction to negotiate with the top-ranked firm should be rescinded for reasons that will be addressed when the Motion to Rescind is considered by the Board.

If the Motion to Consider Rescission is approved, it is requested that, if the appeal of the protest denial is unsuccessful, the Motion to Rescind be considered by the Board at its first meeting after the appeal is denied. A successful appeal of the protest denial would moot the reason for the Motion to Rescind because the matter would be sent back to the Board for further consideration and direction.
