CULTURAL DIVISION RECOMMENDS APPROVAL OF THE ABOVE MOTION.
This item supports the Board's value of "Cultivating community culture, arts, recreation and life-long learning" and goals to provide diverse artistic, cultural, educational and historical amenities and programs that contribute to a vibrant, multi-cultural and economically-viable community.
Broward County’s Cultural Division ("Division") requests the Board to approve a new standard form agreement for Cultural Incentives (Grants) Programs for use for Fiscal Year 2018, commencing on October 1, 2017 through September 30, 2018, and for up to four additional fiscal years, with any subsequent substantive legal updates approved by the Office of the County Attorney or minor changes as the Division's Director determines appropriate subject to approval of the Office of the County Attorney.
The standard proposed form agreement is for use with recipients (grantees), including public entities, non-profit organizations, or individual grantees.
The Board approves the funding amount for each of the recipients (grantees) within the following eight Cultural Incentive Programs: Cultural Investment Program; Cultural Tourism Program; Cultural Institution Program; Regional Investment Program; Cultural Diversity Program; Community Arts Education Partnerships; Cultural Planning and Facilities Program; and Tourist Development Tax Capital Challenge Grant Program.
The Board approves the fiscal year's budgeted amounts for each of the following three Cultural Incentive (Grant) Programs: Creative Investment Program, Creative Place Making Program, and Cultural Festival Program; and the Broward Cultural Council approves the recommended amount for each of the recipients (grantees), subject to the budgeted amount for the three respective programs.
The use of the standard form agreement shall be in accordance with the authority provided in the Broward County Administrative Code, Chapter 29, Part II, Section 29.17, and Chapter 33, Part IV, Sections 33.30 and 33.31.
Any agreement which deviates in any material respect from the approved standard form agreement shall be presented to the Board for approval and execution unless the modification is in accordance with the Broward County Administrative Code, the approved form agreement or the authorizing resolution.
The recommended revisions to the incentive form agreement also reflect updated legal and administrative changes, and have been reviewed by the Risk Management Division and the Office of the County Attorney as to form. The new standard form agreement will not change the eligibility or funding requirements for the incentive programs. Eligibility for the programs are governed by the Broward County Administrative Code. Funding is not being approved by this action. Funding for the grantees and for some of the programs will be approved at the final budget hearings on September 26, 2017, if not already budgeted.
