MOTION TO CONSIDER enactment of an Ordinance, the title of which is as follows:
 
AN ORDINANCE OF THE BOARD OF COUNTY COMMISSIONERS OF BROWARD COUNTY, FLORIDA, PERTAINING TO THE BROWARD COUNTY ZONING CODE; AMENDING SECTION 39-138 OF THE BROWARD COUNTY CODE OF ORDINANCES ("CODE"), DELEGATING AUTHORITY FOR COMPROMISE AND SETTLEMENT OF LAND CLEARANCE LIENS TO THE COUNTY ADMINISTRATOR; AND PROVIDING FOR SEVERABILITY, INCLUSION IN THE CODE, AND AN EFFECTIVE DATE.

Why Action is Necessary
A Resolution directing the County Administrator to publish notice of public hearing to consider enactment of the Ordinance was adopted by the Board of County Commissioners at its meeting of August 22, 2017.

Amends the Code to delegate authority to the County Administrator for compromise and settlement of land clearance liens.

Summary Explanation/Background
Article X of Chapter 39 of the Broward County Code of Ordinances ("Zoning Code") establishes minimum standards governing the maintenance, appearance, and condition of properties in unincorporated Broward County. The minimum standards require property owners to maintain their property free of overgrown groundcover or hedges, junk items, debris, garbage, litter, and trash. If a property owner fails to maintain the property consistent with said minimum standards, following notice to the property owner and an opportunity to bring the property into compliance, Broward County is authorized to bring the property into compliance and assess the property owner for the costs and expenses incurred. Unpaid costs and expenses may become a lien against the property.
 
Currently, Section 1-51.3 of the Broward County Code of Ordinances provides the County Administrator with the authority to settle, compromise, and adjust liens which run in favor of Broward County that are in the amount of $2,500 or less. The proposed Ordinance would authorize the County Administrator to mitigate and release land clearance liens of any amount and to provide the Board of County Commissioners with a quarterly report of the satisfactions and releases executed and recorded during the prior calendar year quarter.
