MOTION TO CONSIDER APPROVAL of New Findings of Adequacy for a plat entitled Haig & Duke Plat (002-MP-04). (Commission District 2)

ACTION:  (T-10:38 AM)  Approved the plat subject to staff’s recommendations as outlined in the Development Review Report.

Why Action is Necessary
Findings of adequacy for plats approved pursuant to Chapter 5, Article IX of the Broward County Code of Ordinances (The Broward County Land Development Code) expire five years from the approval date. New findings of adequacy must be approved by the Board of County Commissioners before a building permit can be issued.
What Action Accomplishes
Approves findings of adequacy for another five years for the plat, subject to staff recommendations and conditions assuring compliance with the standards and requirements of the Broward County Land Development Code.

Summary Explanation/Background
THE ENVIRONMENTAL PROTECTION AND GROWTH MANAGEMENT DEPARTMENT AND THE PLANNING AND DEVELOPMENT MANAGEMENT DIVISION RECOMMEND APPROVAL, subject to staff recommendations and conditions which will assure compliance with the standards and requirements of Chapter 5, Article IX of the Broward County Code of Ordinances.

The applicant is requesting approval of an application for new findings of adequacy, to amend the plat note to develop a city park/recreational use, and to eliminate an opening in the non-vehicular access line. The property is approximately 1.6 acres located on west side of Banks Road, between Northwest 15 Street and Northwest 17 Street, in the City of Margate. The plat was approved on December 14, 2004 for 24,800 square feet of warehouse use with a requirement that either a building permit be issued infrastructure for development be installed by December 14, 2009. The property remains vacant and the findings of adequacy expired on December 14, 2011. See attached Development Review Report.
