Summary Explanation/Background
PUBLIC WORKS DEPARTMENT/HIGHWAY CONSTRUCTION AND ENGINEERING DIVISION RECOMMENDS APPROVAL.

South Andrews Avenue is a County road located in the City of Fort Lauderdale. Blackhawk Properties & Investments, LLC and the City of Fort Lauderdale desire to improve a portion of the County right-of-way along the east side of South Andrews Avenue north of SE 6th Street.

The proposed improvements include sidewalk pavers, pedestrian lighting, landscaping and irrigation. Blackhawk Properties & Investments, LLC will be obligated to maintain these improvements. The landscaping improvements shall incorporate a minimum 50% native species by plant types and shall follow the Broward County NatureScape program and Florida-Friendly Landscaping principles. In the event that Blackhawk Properties & Investments, LLC fails to maintain the improvements, the City of Fort Lauderdale is obligated to perform the maintenance. The agreement also allows the County to terminate the agreement with or without cause at any time. If the agreement is terminated, Blackhawk Properties & Investments, LLC must remove all improvements within the licensed right-of-way and restore the property.

The City of Fort Lauderdale and Blackhawk Properties & Investments, LLC submitted all necessary documentation required by the Office of the County Attorney in July 2017 and this agreement is now ready for the Board of County Commissioners’ consideration.

The agreement has been reviewed and approved as to form by the Office of the County Attorney and the Risk Management Division.
