MOTION TO ADOPT Resolution No. 2017-416 directing the County Administrator to publish Notice of Public Hearing to be held on Thursday, September 14, 2017, at 10:00 a.m., in Room 422 of the Governmental Center to consider adoption of a proposed Resolution Amending the Administrative Code, the title of which is as follows:

A RESOLUTION OF THE BOARD OF COUNTY COMMISSIONERS OF BROWARD COUNTY, FLORIDA, PERTAINING TO THE CONFLICTS OF INTEREST POLICY FOR OUTSIDE LEGAL COUNSEL; AMENDING SECTION 18.88 OF THE BROWARD COUNTY ADMINISTRATIVE CODE ("ADMINISTRATIVE CODE"); AND PROVIDING FOR SEVERABILITY, INCLUSION IN THE ADMINISTRATIVE CODE, AND AN EFFECTIVE DATE.

Broward County's Conflicts of Interest Policy for Outside Legal Counsel is potentially underinclusive in the types of potential conflicts of interest it prohibits as it primarily restricts outside legal counsel's representation of other parties in litigation matters but fails to account for certain potential nonlitigation conflicts that may arise. It is also potentially overly restrictive in the representations that it allows outside legal counsel, as it prohibits outside legal counsel from representing another party before any County board or agency regardless of adversity. The proposed amendments to the Conflicts of Interest Policy for Outside Legal Counsel seek to address these issues in order to ensure that the County is able to choose the most appropriate legal counsel.
