A. MOTION TO ENACT Ordinance amending the Broward County Comprehensive Plan to adopt Broward County Land Use Plan map amendment PC 17-4, establishing an "Activity Center" in the City of Pembroke Pines (Commission District 6), the substance of which is as follows:

AN ORDINANCE OF THE BOARD OF COUNTY COMMISSIONERS OF BROWARD COUNTY, FLORIDA, ADOPTING AN AMENDMENT TO THE BROWARD COUNTY COMPREHENSIVE PLAN; AMENDING THE BROWARD COUNTY LAND USE PLAN OF WITHIN THE CITY OF PEMBROKE PINES; AND PROVIDING FOR SEVERABILITY AND AN EFFECTIVE DATE.

ACTION:  (T-11:06 AM)  Filed proof of publication and enacted the Ordinance to become effective as provided by law.  (Refer to minutes for full discussion.)
 
VOTE: 8-0.  Commissioner Geller abstained from voting.

AN ORDINANCE OF THE BOARD OF COUNTY COMMISSIONERS OF BROWARD COUNTY, FLORIDA, ADOPTING AN AMENDMENT TO THE BROWARD COUNTY COMPREHENSIVE PLAN BY AMENDING THE BROWARD COUNTY LAND USE PLAN TEXT REGARDING THE CITY OF PEMBROKE PINES ACTIVITY CENTER; AND PROVIDING FOR SEVERABILITY AND AN EFFECTIVE DATE.

ACTION:  (T-11:06 AM)  Filed proof of publication, as amended, including amendments presented by the City of Pembroke Pines and enacted the Ordinance to become effective as provided by law.  (Refer to minutes for full discussion.)

Why Action is Necessary
Pursuant to Section 163.3184, Florida Statutes, as amended, Broward County Comprehensive Plan amendments shall be adopted by the Broward County Board of County Commissioners, serving as the local governing body.
What Action Accomplishes
The Ordinances adopt Broward County Land Use Plan map amendment PC 17-4, and corresponding text amendment PCT 17-2, in accordance with Section 163.3184, Florida Statutes, as amended.

March 28, 2017 - County Commission approved transmittal of proposed map amendment PC 17-4, and corresponding text amendment PCT 17-2, to State review agencies; and June 13, 2017 - Set adoption Public Hearing for August 22, 2017.
Summary Explanation/Background
The Planning Council, as the Local Planning Agency (LPA) responsible for the Broward County Land Use Plan, considered the following proposed map amendment, PC 17-4, and corresponding text amendment PCT 17-2, at its February 23, 2017, public hearing, and recommended approval, subject to amending the Educational Mitigation Agreement, if necessary (Vote of the board; Unanimous: 14-0; Blackwelder, Blattner, Castillo, DiGiorgio, Fink, Gomez, Good, Graham, Grosso, McColgan, Parness, Udine, Williams and Stermer) and also recommended approval at its May 25, 2017, public hearing, subject to amending the Educational Mitigation Agreement, if necessary (Vote of the board; Unanimous: 14-0; Blackwelder, Castillo, DiGiorgio, Ganz, Gomez, Good, Graham, Grosso, Rosenof, Rosenzweig, Ryan, Seiler, Williams and Stermer) :

A. AMENDMENT PC 17-4

Amendment to the Broward County Land Use Plan - City of Pembroke Pines

From 18.2 acres of Employment Center - High and 146.37 acres of Local Activity Center (LAC) to Activity Center (AC)
Approximately 164.6 acres; generally bound on the north by Pines Boulevard, on the east by Palm Avenue and on the south by Washington Street.

B. AMENDMENT PCT 17-2

Amendment to the Broward County Land Use Plan text corresponding to proposed Broward County Land Use Plan map amendment PC 17-4, in the City of Pembroke Pines.

The full amendment reports and associated attachments are provided in Exhibits 2 and 4 of this Public Hearing item.

Subsequent to the Planning Council's second public hearing on May 25, 2017, the City of Pembroke Pines submitted an additional request to allow the conversion of office to commercial uses and vice versa. Please note that this proposal was not the subject of a Planning Council public hearing. Planning Council staff analysis indicates that there would be no net impact to facilities and services and has no objection to the modification.

Planning Council staff is of the opinion that the issue of modifying the proposed text is at the pleasure of the Broward County Commission.
