The Office of Economic and Small Business Development did not assign participation goals to this Agreement based on the sole source/sole brand request.
The purpose of this item is to approve the sole source/sole brand standardization of the Brock Solutions U.S. Inc. SmartSort Upper Level Software and Lower Level Controls for the Baggage Handling System, and provide for the continuation of the System and Services Agreement for the baggage handling system for Terminals 1, 2, 3 and 4 at the Broward County Fort Lauderdale-Hollywood International Airport.
On September 17, 2013, Broward County entered into an agreement with Brock Solutions U.S., Inc. for Software License and Maintenance Services for the Broward County Aviation Department. This Agreement provided for Maintenance Support Services to Broward County on a 24-hour, seven days a week basis.
On July 24, 2017, the Aviation Department requested the approval of the sole source/sole brand standardization designation in its most reasonable source request submitted to Purchasing, due to the protected nature of Brock Solutions U.S. Inc.’s Programmable Logic Controller (PLC) code and Brock Solutions U.S. Inc.'s intellectual property standard code. Brock Solutions U.S. Inc. is the only company with access to the source code for these systems. Purchasing reviewed and approved the Aviation Department's most reasonable source request; and is recommending the approval of the sole source/sole brand standardization designation (Exhibit 3).
Payments will be based on the maximum amount payable under this Agreement, which has been reviewed by the Office of the County Attorney. The Agreement Summary reflects the actual amount of the Agreement.
Two Sunshine meetings were held to negotiate this Agreement: May 2 and May 10, 2017. The meetings were attended by representatives from Brock Solutions U.S. Inc., the Purchasing Division and the Aviation Department. |
