Requested Action
MOTION TO AWARD open-end contract to low bidder, IPS Lynx, Inc., for ADA Paratransit Functional Assessments, Bid No. V2114207B1, for the Transit Division, in the three-year estimated amount of $922,650, and authorize the Director of Purchasing to renew the contract for two one-year periods, for a five-year potential estimated amount of $1,537,750. The initial contract period begins on the date of award and terminates three years from that date.

Why Action is Necessary
In accordance with the Broward County Procurement Code, Section 21.31.a.4, the Board is required to approve all purchases exceeding $250,000 per annum or $400,000 in a multi-year period.

Summary Explanation/Background
THE PURCHASING DIVISION AND THE TRANSPORTATION DEPARTMENT/TRANSIT DIVISION RECOMMEND APPROVAL OF THE ABOVE MOTION.

This item supports the Board's Value of “Cooperatively delivering an efficient and accessible regional intermodal transportation network”; and its Goal No. 1 to “Actively seek through an effective marketing plan, a full penny transportation surtax in 2018 to support a world-class intermodal transportation system including: a robust and reliable transit level of service, rail, intersection reconfiguration, adaptive signalization, and congestion relief.”

The Office of Economic and Small Business Development did not assign County Business Enterprise (CBE) goals for this procurement because there are no subcontracting opportunities for CBE contractors (Exhibit 3).

The purpose of this solicitation is to provide a contract for the performance of in-person functional assessments to determine if passenger applicants meet the federal criteria for Americans with Disabilities Act (ADA) paratransit eligibility. The testing process not only reviews the individuals' disabilities, but also tests the applicants' functional skills that are used by fixed-route bus passengers. By using this independent third party professional process and certifying only those individuals who meet federal ADA eligibility criteria, Paratransit Program costs are reduced.

Upon application of the Local Preference Ordinance, a Best and Final Offer (BAFO) process was instituted between IPS Lynx, Inc. (non-local vendor) and Neurological Rehabilitation Center Program Services, Inc. (local vendor).  Only IPS Lynx, Inc. submitted a BAFO response and, therefore, was determined to be the low responsive, responsible bidder. The three-year estimated amount was reduced to $922,650, a reduction of $137,730 from the original bid price (Exhibit 2).

The Transit Division has reviewed the bid submitted by IPS Lynx, Inc., and concurs with the recommendation for award (Exhibit 4).  No vendor performance evaluations were completed for IPS Lynx, Inc.

Incumbent: Neurological Rehabilitation Center Program Services, Inc. Contract Title: Americans with Disabilities Act (ADA) Paratransit Eligibility Assessments, Contract No. V0985905B1, Contract Term: May 1, 2012 to April 30, 2017. Expenditures to date: $1,434,984.

There was no protest or appeal filed regarding this procurement.

The bid posted on April 25, 2017 and opened on May 24, 2017; two bids were received with no declinations (Exhibit 1).
