MOTION TO NOTE FOR THE RECORD emergency award of open-end contract to the low responsive, responsible bidder, Quasius Investment Corporation DBA GCA for Forcepoint Appliances and Software Maintenance and Support, Bid No. A2114203B1, for the Enterprise Technology Services Division, in the estimated annual amount of $153,053, and authorize the Director of Purchasing to renew the contract for four one-year periods for a five-year potential estimated amount of $765,264. The initial term of the contract period began on June 30, 2017 and terminates one year from that date.

Why Action is Necessary
In accordance with the Broward County Procurement Code, Section 21.39.b., an emergency procurement exceeding the award authority of the Director of Purchasing must be reported to the Board.

Summary Explanation/Background
THE PURCHASING DIVISION AND THE FINANCE AND ADMINISTRATIVE SERVICES DEPARTMENT/ENTERPRISE TECHNOLOGY SERVICES DIVISION RECOMMEND APPROVAL OF THE ABOVE MOTION.

There were no goals assigned to this contract because an emergency procurement approved by the Director of Purchasing is exempt from application of participation goals.

On May 18, 2017, an emergency request was received from the Chief Information Officer of the Enterprise Technology Services Division for the annual maintenance and support of Forcepoint, formally known as Websense, which provides web content filtering operations by blocking Internet access to offensive, hate promoting, non-business, cybersecurity threat websites and purchase of Forcepoint Data Loss Prevention Module, which is at end of life (Exhibit 1).

On June 8, 2017, an emergency solicitation was issued. Three responses were received with no declinations (Exhibit 2).

On June 29, 2017, the Director of Purchasing awarded an open-end contract to the low responsive, responsible bidder, Quasius Investment Corporation DBA GCA. The Director of Purchasing determined the apparent low bidder, Internet Content Management, to be non-responsive to the solicitation requirements for taking exceptions to the County’s insurance requirements and to Special Instructions to Vendors, Section N Liquidated Damages (Exhibit 3).

The initial bid submitted by Quasius Investment Corporation DBA GCA was $141,634; the vendor offered a voluntary price reduction of $752. The Broward County Procurement Code, Section 21.130f.2(c), allows for a voluntary price reduction of the bid price, if the reduction does not result in the modification or deletion of any condition of the bid.

The amount referenced in this agenda has been rounded to the nearest whole dollar. Vendor payments will be based on the actual total bid amount (or the maximum amount payable under this contract). The bid tabulation reflects the actual amount of the annual award. In early August, however, Purchasing Division staff were advised that County residents' response to the County's Digital Divide Program has been so positive that plans are to accommodate 1,000 licenses rather than the initial plan for 300 licenses. The dollar amounts in the Motion reflect the increased licenses.
