Requested Action
MOTION TO AWARD open-end contract to low bidder, FG Construction, LLC, for Sidewalk and Drainage System Repair and Replacement, Bid. No. N2113654B1, for the Highway and Bridge Maintenance Division, in the estimated annual amount of $2,418,875, including allowances for permits, specialized construction services, unforeseen conditions, and materials and parts in the amount of $420,000; and authorize the Director of Purchasing to renew the contract for two one-year periods, for a total potential three-year amount of $7,256,625. The contract shall begin on the date of award and shall terminate one year from that date, contingent upon the receipt and approval of performance and payment guaranty.

Why Action is Necessary
In accordance with the Broward County Procurement Code, Section 21.31.a.4, the Board is required to approve all purchases exceeding $250,000 per annum or $400,000 in a multi-year period.
What Action Accomplishes
The purpose of this contract is to provide all labor, materials, equipment, and incidentals necessary to perform construction services to replace and repair sidewalks and drainage systems throughout the County.

Summary Explanation/Background
THE PURCHASING DIVISION AND THE PUBLIC WORKS DEPARTMENT/HIGHWAY AND BRIDGE MAINTENANCE DIVISION RECOMMEND APPROVAL OF THE ABOVE MOTION.

The Office of Economic and Small Business Development (OESBD) established a County Business Enterprise (CBE) goal of 30% for this contract.  FG Construction, LLC (FG Construction) committed to 31.6% CBE participation, which has been approved by the OESBD (Exhibit 2).

The purpose of this contract is to provide all labor, materials, equipment, and incidentals necessary for construction services to replace and repair sidewalks and drainage systems throughout the County.  The sidewalks and ramps will be constructed to ensure compliance with the Americans with Disabilities Act, Florida Department of Transportation Standard Specifications for Roads and Bridge Construction, and Broward County specifications governing the public right of ways. 

The allowances incorporated in this contract, in the total amount of $420,000, are for permits, specialized construction services, unforeseen conditions, and materials and parts that may be needed during the course of the contract. Expenditures under this allowance item must be approved by the contract administrator and will be reimbursed at the contractor’s actual incurred cost, without mark-up.

This procurement carries a 50% performance and payment bond.  The Purchasing Division has confirmed with the surety company that FG Construction has the capacity to obtain the required bond.

The Highway and Bridge Maintenance Division has reviewed the bid submitted by the low bidder, FG Construction, and concurs with the recommendation for award (Exhibit 3). Fourteen performance evaluations were completed for FG Construction; the firm has an overall rating of 3.97 out of a possible 5.0.  Copies of the vendor performance evaluations are available upon request.

The Highway and Bridge Maintenance Division reviewed FG Construction's prices and found the prices to be fair and reasonable.  FG Construction's bid is 36% below the independent cost analysis completed by the Highway and Bridge Maintenance Division (Exhibit 4).

The previous contract, Bid No. M0864903B1, was awarded by the Board on June 7, 2011 (Item No. 6). The contract term started on June 7, 2011 and ended on June 6, 2014. Total expenditures for Contract No. M0864903B1 was $7,816,657.

There was no protest or appeal filed regarding this procurement.

The bid posted on April 5, 2017, and opened on May 19, 2017; three bids were received with no declinations (Exhibit 1).
