MOTION TO AWARD open-end contract to low responsive, responsible bidder, Toshiba Business Solutions for Bid No. A2114041B1, Copiers, Cost-Per-Copy, for the Enterprise Technology Services Division, in the five-year estimated amount of $3,491,275. The initial contract period begins on September 13, 2017, and terminates five years from that date, contingent upon receipt and approval of performance and payment guaranty.

Why Action is Necessary
In accordance with the Broward County Procurement Code, Section 21.31.a.4, the Board is required to approve all purchases exceeding $250,000 per annum or $400,000 in a multi-year period.

Summary Explanation/Background
THE PURCHASING DIVISION AND THE FINANCE AND ADMINISTRATIVE SERVICES DEPARTMENT/ENTERPRISE TECHNOLOGY SERVICES DIVISION RECOMMEND APPROVAL OF THE ABOVE MOTION.

The Office of Economic and Small Business Development did not establish County Business Enterprise (CBE) goals for this contract because there are no subcontracting opportunities for CBE contractors (Exhibit 2).

The purpose of this contract is to provide copiers on a cost-per-copy basis to various County agencies. This procurement carries a $200,000 performance and payment bond. The Purchasing Division has confirmed with the surety company that Toshiba Business Solutions has the capacity to obtain the required bond.

The Enterprise Technology Services Division reviewed the bid submitted by the low responsive, responsible bidder, Toshiba Business Solutions, and concurs with the recommendation for award (Exhibit 3).

Five vendor performance evaluations were completed for Toshiba Business Solutions with an average of 4.94 out of a possible rating of 5.0. Copies of the vendor performance evaluations are available upon request.

The Director of Purchasing has determined the apparent low bidder, ImageNet Consulting, to be non-responsive to the bid requirements due to the omission of the bid bond from its bid submittal at the time of submission.

The Director of Purchasing has determined the apparent second low bidder, Canon Solutions America, to be non-responsive because the vendor took exceptions to the County’s standard terms and conditions.

The amounts referenced in this agenda were rounded to the nearest whole dollar. Vendor payments will be based on the actual total bid amount. The bid tabulation reflects the actual amount of the award. A voluntary price reduction was sought but declined by Toshiba Business Solutions.

There was no protest or appeal filed regarding this procurement.

Incumbent: Toshiba Business Solutions; Contract Title and Number: Copiers, Cost-Per-Copy, D0982507B2; Contract Term: August 28, 2012 through September 12, 2017; Expenditures to Date: $3,265,466.

The purchasing agent has researched the prices submitted by the recommended bidder, Toshiba Business Solutions, and has determined that the prices submitted are fair, reasonable and aligned with market analysis for the industry in comparison to the previous Broward County contract (Exhibit 4).

The bid posted on May 19, 2017 and opened on July 5, 2017; four bids were received with two declinations (Exhibit 1).
