MOTION TO AWARD open-end contract to low bidder, Sunshine Recycling Services of S.W. Florida, L.L.C., for Trash Pick-up for Various Locations, Bid No. G2113795B1, for the Facilities Management Division, in the three-year estimated amount of $920,948, plus an additional “pass thru” for franchise and disposal fees, in the three-year estimated amount of $480,000, for a total estimated amount of $1,400,948; and authorize the Director of Purchasing to renew the contract for two one-year periods, at an annual estimated amount of $466,982, for a five-year potential estimated amount of $2,334,913. The initial contract period begins on October 1, 2017 and terminates three years from that date.

Why Action is Necessary
In accordance with the Broward County Procurement Code, Section 21.31.a.4, the Board is required to approve all purchases exceeding $250,000 per annum or $400,000 in a multi-year period.

Summary Explanation/Background
THE PURCHASING DIVISION AND THE PUBLIC WORKS DEPARTMENT/FACILITIES MANAGEMENT DIVISION RECOMMEND APPROVAL OF THE ABOVE MOTION.

The Office of Economic and Small Business Development did not assign County Business Enterprise participation goals to this solicitation based on the review of services requested (Exhibit 2).

The purpose of this contract is to provide trash pick-up and disposal services for County-owned locations that are in non-exclusive franchised areas.

The Broward County disposal tipping fee for roll-off containers, which is currently set at $40 per ton, along with any city franchise fees for all containers are a “pass thru” charge and were not included in the evaluation of the bid or the tabulated bid results. The awarded vendor will be required to include any applicable disposal and franchise fees with the invoice.

In accordance with the Broward County Living Wage Ordinance, No. 2008-45, as amended, Section 26-101 (i), these are covered services. Sunshine Recycling Services of S.W. Florida, L.L.C. has agreed to be bound to the contractual obligations of the Living Wage Ordinance.

The Facilities Management Division has reviewed the bid submitted by Sunshine Recycling Services of S.W. Florida, L.L.C. and concurs with the award recommendation (Exhibit 3). One vendor performance evaluation has been completed for the bidder with an average of 4.26 out of a possible 5.0. A copy of the performance evaluation is available upon request.

All prices, terms and conditions shall remain firm for the initial and the renewal periods. In accordance with the price adjustment clause included in the contract, the vendor may request a price increase at least 60 days prior to the renewal date. Upon mutual agreement, the County may allow the price adjustment, as deemed appropriate.

There was no protest or appeal filed regarding this procurement.

Incumbents: Progressive Waste Solutions of Florida DBA Waste Connections of Florida (formerly Choice Environmental Services of Broward, Inc.) and Sunshine Recycling Services of S.W. Florida, L.L.C.. Contract Number(s) and Title(s): G1008932B1, Trash Pick-up/Various Locations and G1340013B1, Bulk Trash Roll-Off Container Services. Contract Term(s): July 1, 2012 to September 30, 2017 and October 1, 2015 to September 30, 2017. Expenditures to-date: $1,355,319.

The previous Contract G1008932B1, Trash Pick-Up/Various Locations, was awarded by the Board on June 5, 2012 (Item No. 29). The contract term started on July 1, 2012 and ended on June 30, 2017. The County invoked the 90-day contract extension from July 1, 2017 to September 30, 2017, as allowed by the solicitation document.

The amounts referenced in this agenda were rounded to the nearest whole dollar. Vendor payments will be based on the bid specifications. The bid tabulation reflects the actual amount of the award.

The bid posted on March 14, 2017 and opened on March 29, 2017; five bids were received with no declinations (Exhibit 1).
