THE PUBLIC WORKS DEPARTMENT/FACILITIES MANAGEMENT DIVISION/REAL PROPERTY SECTION RECOMMENDS APPROVAL OF THE ABOVE MOTION.
On February 7, 2017 (Item No. 2), the Board of County Commissioners approved the Agreement for Sale and Purchase for the purchase of a 7.29 acre site located on the west side of NW 23rd Avenue at NW 17th Street in Fort Lauderdale from The School Board of Broward County (SBBC). This parcel is identified by Folio Number 4942-32-22-0012. The Agreement provided for an inspection period of 85 days, which expired on May 18, 2017. Following Phase I and Phase II environmental assessments, an expanded Phase II assessment was completed on May 12, 2017 and found low levels of arsenic. While the level of concentration is below the threshold for commercial/industrial use, further testing is necessary to determine the extent of contamination.
In order to extend the inspection period, SBBC requires approval from its Board which does not meet until June 13, 2017. In order to ensure the security deposit of $313,000 was not put at risk, the County timely terminated the Agreement prior to the expiration of the inspection period.
SBBC and County staff negotiated the proposed Reinstatement and First Amendment to the Agreement of Sale and Purchase, which will be presented to the SBBC for approval on June 13, 2017. The proposed agreement reinstates the Agreement for Sale and Purchase and provides for an extension of the inspection period for up to 150 days; however, staff anticipates the actual work to be completed within 60 days. Staff is requesting that the County Administrator be authorized to execute the proposed agreement in substantially the form attached upon SBBC approval of same.
All documents will be subject to the approval by the Office of the County Attorney.
