THE ENVIRONMENTAL PROTECTION AND GROWTH MANAGEMENT DEPARTMENT AND THE PLANNING AND DEVELOPMENT MANAGEMENT DIVISION RECOMMEND APPROVAL.
A request has been filed for a second amendment to the Regional Road Concurrency Agreement related to the Duke Pembroke “A” Plat recorded in Official Records Book 44843, Page 840 (Exhibit 1). The plat is located on the east side of I-75 and south of Pines Boulevard, in the City of Pembroke Pines on 17.3 acres (Exhibit 2).
On November 6, 2007, the plat was approved with a Regional Road Concurrency Agreement to partially fund the construction of the Pembroke Road bridge over I-75 between Southwest 136 Avenue and Southwest 160 Avenue in the amount of $426,080 prior to plat recordation. On April 28, 2009, the first amendment to this agreement (Official Records Book 46189, Page 1994) was approved by the Board to amend timing of the payment and to require a surety bond.
This plat is located in the Transportation Concurrency Management Area and transportation concurrency fees will be assessed and paid in accordance with the fee schedule specified in the Land Development Code during the review of construction plans submitted for County environmental review approval. Broward County no longer requires security for the payment of Transit Concurrency Fees. The applicant is requesting to amend the agreement to remove the requirement for a surety bond (Exhibit 3).
This agreement has been approved as to form by the County Attorney’s Office.
