THE FINANCE AND ADMINISTRATIVE SERVICES DEPARTMENT AND THE RISK MANAGEMENT DIVISION RECOMMEND APPROVAL OF THE ABOVE MOTION.
On September 15, 2014, the claimant, a former Bus Operator, sustained an injury during the course and scope of employment with the Broward County Transit Division. The claimant alleged injuries to the head, neck, back, and both shoulders after the bus was rear-ended by a tractor trailer. Due to the injury suffered from this accident, the claimant was terminated on May 6, 2016.
Through negotiations with the claimant, a settlement was reached in the total amount of $200,000. This amount is broken down as follows: (1) The claimant will receive $172,528, plus $500 for a Release and Resignation Agreement; and (2) the claimant’s attorney will receive $20,000 for fees and $6,972 for costs. The settlement includes all future indemnity and medical benefits.
Please note the Concurrence Memorandum was signed by the Office of the County Attorney on May 8, 2017, which is within the 90-day period between settlement and concurrence, as requested by the Board.
