THE BROWARD COUNTY AVIATION DEPARTMENT RECOMMENDS APPROVAL OF THE ABOVE MOTION.
This action will approve a resolution to amend Chapter 39 in the Broward County Administrative Code ("Administrative Code") to modify fees for transportation network companies and update the payment procedures for prearranged vehicles and courtesy vehicles.
Currently, various transportation network companies ("TNCs") have agreements with Broward County ("County"), which outline the various roles and responsibilities of the TNCs and the County, including the requirement that TNCs pay a fee for each pick-up at Broward County's Fort Lauderdale-Hollywood International Airport ("Airport").
Chapter 39 of the Administrative Code, which outlines the fees and charges at the Airport, provides that taxicabs shall be required to pay a trip fee in the amount of $3.00 per trip. During the 2017 legislative session, the Florida Legislature approved legislation which allows airports to charge reasonable pick-up fees to TNCs, but required that such fees be consistent with any pick-up fees charged to taxicab companies for their use of the Airport's facilities. TNCs currently pay a $4.50 pick-up fee to use the Airport's facilities.
This proposed Resolution (Exhibit 1) requires that TNCs similarly be required to pay a pick-up fee in the amount of $3.00 per pick-up for their use of the Airport’s facilities. This fee reduction from $4.50 to $3.00 is necessary to comply with the legislation approved by the Florida Legislature and signed into law by the Governor, which will be in effect on July 1, 2017.
The proposed Resolution also updates the payment procedures for prearranged vehicles and courtesy vehicles that use the Airport. The current language of the Administrative Code requires that prearranged vehicles and courtesy vehicles self-report, but that is no longer necessary now that the Airport uses automatic vehicle identification ("AVI") technology. This proposed Resolution requires that all per pick-up fees for the previous month's Ground Transportation Services by prearranged vehicles and courtesy vehicles be due and payable to the Aviation Department within 15 days from the date of invoice.
The proposed Resolution has been approved as to form and legal sufficiency by the Office of the County Attorney.
