The Office of Economic and Small Business Development did not establish a County Business Enterprise (CBE) goal for this procurement because there are no subcontracting opportunities for CBE contractors (Exhibit 2).
Section 21.36 of the Procurement Code allows for the Director of Purchasing to purchase directly from local contracts when the contract expressly permits, or if the awarding jurisdiction and/or the vendor agree to allow the County to purchase therefrom.
The purpose of this contract is to provide unleaded gasoline and diesel fuel for countywide use.
This cooperative contract, awarded by the City of Pompano Beach, is to be used only by various participating government agencies listed in the contract. The estimated award amount of $55,000,000 reflects only the County’s usage; it does not include the annual usage of the other Co-op members.
The Southeast Florida Governmental Purchasing Cooperative Group is an organization of various Southeast Florida cities, counties and governmental agencies that provides for cooperative purchasing, in which quantities for the same item are combined in order to achieve economies of scale through volume discount pricing. The City of Pompano Beach is the lead agency for this Co-op contract and facilitated the solicitation and subsequent implementation of a contract. Estimated usage quantities were obtained from each participating agency prior to the solicitation. Each participating agency concurred with the Request for Proposals (RFP) specifications utilized by the City of Pompano Beach. A staff person from the Fleet Services Division served as an Evaluation Committee Member during the evaluation of the responses received.
The RFP posted on December 19, 2016 and opened on January 19, 2017; six responses were received with no declinations.
On March 15, 2017, the City of Pompano Beach awarded Co-op Contract RFP No. E-13-17 to the highest ranked proposer, Port Consolidated, Inc., for an initial three-year contract term with two one-year renewal options. The initial contract term began on March 15, 2017 and expires on March 14, 2020.
All prices, terms and conditions shall remain firm for the initial and renewal periods. In accordance with the price adjustment clause included in the contract, the vendor may request a price increase at least 90 days prior to the end of the contract term. Upon mutual agreement, the County may allow the price adjustment, as deemed appropriate.
There was no protest or appeal filed regarding this procurement.

Incumbent: MacMillan Oil Company, LLC (formerly MacMillan Oil Company of Florida, Inc.), Contract Number and Title: V1264207G1, Unleaded Gasoline and Diesel Fuel. Contract Term: July 1, 2014 through March 14, 2017. Expenditures to Date: $53,378,588. On March 14, 2017, Item No. 83, the Board approved a month-to-month interim contract, not to exceed six months, which is being utilized until a replacement contract is implemented. |
