THE TRANSPORTATION DEPARTMENT/TRANSIT DIVISION RECOMMEND APPROVAL OF ABOVE MOTION.

This item supports the Board's Vision and Values for "Cooperatively delivering an efficient and accessible regional intermodal transportation network" and "Consistently delivering responsive, efficient, quality services to the public and internal customers" by improving and enhancing the transit system. This item effectuates service improvements included in the Mobility Plan funded by transportation surtax revenues, passed by voters on November 6, 2018.

Proposed improvements on routes 4, 12, 15, 16, 19, 23, 31, 55, 56, 62, 88, 101, and restoration of service on route 8 are based on a combination of planned service improvements which increase access to transit, improve frequency for better service, and expand service hours to maximize transit connectivity and coverage. These routes constitute approximately 19% of Broward County Transit’s total system ridership. Existing vehicles are being utilized to accomplish these service increases until new vehicles arrive (expected 2020).

In compliance with federal and county regulations, policies and procedures, this public hearing will allow public comment on the following proposed changes to fixed-route bus service to be implemented in the Summer and Fall of 2019 (Phase 1 & 2).  A summary including maps of the affected routes are attached as Exhibit 1.

THE TRANSPORTATION DEPARTMENT AND THE TRANSIT DIVISION RECOMMEND APPROVAL.

Title VI of the Civil Rights Act of 1964, as amended, is a federal statute which provides that no person shall, on the grounds of race, color, or national origin, be excluded from participation in, be denied the benefits of, or be subjected to discrimination under any program or activity receiving federal financial assistance. As a recipient of Federal Transit Administration (FTA) grant funding, the Transit Division (BCT) is required to follow the Title VI Circular 4702.1B, "Title VI Requirements and Guidelines for Federal Transit Administration Recipients," dated October 1, 2012, and prepare an equity analysis when planning a major service or fare change. The federal rules require this report be approved by the Transit agency's governing Board, in this case the Board of County Commissioners, prior to implementing changes.

The Transit Division (BCT) is requesting approval of the Service Equity Analysis (Exhibit 1) for the Mobility Advancement Program (MAP) Fixed-route Bus Service Improvements funded with transportation surtax revenues. BCT fixed-route bus service improvements including a restoration of service on Taft Street (Route 8) and changes to BCT bus routes; 4, 12, 15, 16, 19, 23, 31, 55, 56, 62, 88, 101. These transit service improvements are considered a proposed major service change to BCT fixed-route bus routes service which will begin in the Summer and Fall of 2019. The changes will improve access to transit, improve frequency for better service, and expand service hours to maximize transit connectivity and coverage. These routes constitute approximately 19% of Broward County Transit’s total system ridership.

BCT Major Service changes are defined as changes that exceed any of the following thresholds:

Type Service Change Major Service Change Threshold
Service Miles More than 25% of route miles or weekly revenue miles
Express Service Miles More than 50% of route miles or weekly revenue miles
Headways/Frequency More than 15 minutes
Route Establishment or discontinuation (elimination) of a route
Fares Any change in Fares

Using methodologies consistent with FTA Circular 4702.1B, “Title VI Requirements and Guidelines for Federal Transit Administration Recipients,” the result of Title VI Service Equity Analysis indicates that the service change proposal to implement the first programmed year for the MAP plan will not cause disparate impacts or disproportionate burdens on minority or low-income passengers (Title VI protected populations).

In compliance with federal and county regulations, policies and procedures, a public hearing is scheduled today, June 11, 2019, to allow the public to comment on the proposed establishment of the MAP 2019 Transit Service Improvements.

The Service Equity Analysis, (Exhibit 1), was posted online for public review and comment on BCT's website on May 24, 2019.

Gretchen Cassini 06/11/2019  /  CCCM  1st Amendment to Surtax Interlocal Agreement with MPO & Municipalities  County Administration  Bertha Henry

THE TRANSPORTATION AND PUBLIC WORKS DEPARTMENTS, AS WELL AS COUNTY ADMINISTRATION RECOMMEND APPROVAL.

This action is in furtherance of the Board's Value: "Cooperatively delivering an efficient and accessible regional intermodal transportation network" and the attendant Goals: "Provide a safe, sustainable, integrated and efficient transportation system to enhance Broward County’s economy and livability"; "Support the development, design and construction of sustainable, multi-modal transportation facilities throughout the County, to meet the demands of residents, travelers, and businesses."

On August 21, 2018, the Board of County Commissioners added an action item to a Commission Workshop to allow the Board to approve an interlocal agreement governing the distribution of surtax proceeds and establishing a framework for prioritizing municipal projects. Then-Mayor Furr brought forth the item as a way to solidify municipal support for the November 2018 transportation surtax referendum, by creating a minimum annual revenue guarantee for municipal projects of 10%. The ILA also defined eligible municipal project categories and identified the Broward MPO as the entity responsible for prioritizing municipal projects contained in the Plan. The ILA would only become effective upon municipalities representing at least 50%=1 of the total County population approving it by September 30, 2018. The ILA became effective, as it was approved by 29 of 31 municipalities in 2018, with an additional municipality, Parkland, approving it in 2019.

The First Amendment accomplishes the following:
  1. Clarifies the definitions of eligible municipal projects;
  2. Amends the date municipal project prioritization by surtax-funded MPO staff must be completed from February 2020 to March 2020 to acknowledge delay in completing ILA negotiations;
  3. Recognizes the parties' intent to create a five-year plan that will include all proposed projects funded wholly or in part with surtax proceeds, by July 2020;
  4. Removes MPO's responsibility for prioritizing rehabilitation and maintenance projects allowing those projects to potentially be funded earlier in the 30-year program; and
  5. Other necessary alignments with ILA between the County and MPO approved by the Board of County Commissioners April 16, 2019, Item No. 49.
The First Amendment (Exhibit 1) was distributed to County's city managers, MPO, and Broward League of Cities. Two municipalities contacted the County with questions (Sunrise and Coconut Creek), which were addressed and did not result in any changes to the ILA's content.

The First Amendment was prepared by the Office of the County Attorney. Municipalities and the MPO have been advised that the item will be considered by the County Commission on June 11, 2019. We have requested their respective Boards consider the item no later than September 30, 2019, since action will affect the scope of the MPO's prioritization process, as well as its deadline for completing same. As executed agreements are received and tabulated based on representative population, the Board will be alerted once municipalities representing at least 50%+1 of the County's total population have acted favorably.
